"Unfortunately that's the hell of zero hour contracts, and why they're being outlawed soon. I've worked in a few places on those contracts but not for a few years. I'm surprised the NHS do that tbh! Other than bringing up your issue with the lack of shifts with your superior, there's not much else you can do ![]() When they are outlawed am I able to get a contract even though Iv been there for 2 years? | |||

Can't you get on some Agency books? that way you get paid twice as much per shift than bank." Not 'twice' as much, unless you are a specialist nurse. It was the case that agency are only highlighted at a last resort. | |||

The only change to the law that came into effect in May, is that you have the right to work elsewhere, without getting into trouble, if your hours aren't putting enough bread on the table." I been told to go to HR" Wouldn't that cause a rift if you skip the person who does the scheduling? Ask them first, go to HR if you get nowhere. Join an agency if that's better hours for you. | |||

"I work on a casual contract which is a zero hour contract with no stability! If you're not getting the hours there I would query why, surely you should all be getting equal hours?" I'm wondering this, but I don't think they care. If I'm off sick for any reason and I don't phone in (which I do) I get crossed of the list for 4 weeks, but I'm allowed to but my name back down at the bottom and can and have been given a shift. As soon as the new DBS clearance lands through your door, go online and pay I think it is £15, to renew annually. If you do, you will never have to pay full DBS again, it is also transportable to another job. No waiting for DBS clearance again. BUT, it must be done within 14 days of landing in the post to you. " Unfortunately most agencies (In my experience) don't have in house payroll anymore (mainly due to IR35 Legislation I think). The umbrella company are a rip off (my opinion) as charging approx $15 to process a payslip has a negative effect on lower paid workers. However if going down the agency route make sure to claim back your Expenses Such as travel, subsistence, work tools/clothing and umbrella company fees as these are all tax deductible. | |||

"0 hour contracts are the modern names for surfdom, it costs them nothing not to use you, so they can mess you around and all you can do is say thank you if they toss some scraps from the table. Are you on the bank to specific wards, or all local hospitals and GP surgerys? can you get on the bank for other possibilities? e.g. private hospitals? the only power you have from the 0 hour system is to make yourself available to the highest bidder. " there has been a couple of times where an agency nurse has been used over ours but thats because shes a regular with us - one of our staff became free but was happy to let the agency have the shift as she had been rotad in for it - | |||

If your contract gives you "worker" status then you are entitled to holiday and sick pay (usually rolled up into your hourly rate). You do not have full "employee" status so cannot claim for constructive dismissal or a notice period etc. However there could be grounds to claim constructive dismissal if you are effectively tied to a single employer(contract stating that you must be available to work any shift offered) or if you have been on a long run of working full time hours which have since been cut with no reasonable explanation. | |||

Or, alternatively, someone there might be restricting your hours maliciously. " Ivy never refused to go in. I've not asked for less hours, I have not been putting my name down as much due to personal reasons. Never said I wasn't available for long periods, the longest I've ever had off is 2 weeks ( holiday) Sickness is quite sporadic and I always phone up to let them know. I don't know if there is a new person that allocates work, but whoever allocates the work in the in can all change at the weekends by a supervisor. | |||
