unfair dissmissal

Hi does anyone know the actual laws on unfair dissmissal.i worked for an employer for over 3 months prob 5ish.i got sack for not turning up for work but was at hospital as proof.and turned out to be severe kidney infection. Any advice or help will be apprieciated.x

Only 3 months? 6 months? you have no rights at a tribunal the qualifying period is 2 years...move on and don't go sick next time. Employers are not social sevices. (All subject of course to your contract of employment and statute)

Then ACAS is what you need to start with. They have a good website & their advisors on the phones are excellent too. Good luck - my employment law is too rusty to advise you properly

Surly if you got a cert from the hospital to say you were in due to a bad kidney infection & to say how long you were in hospital for....

In a nutshell: three months employment you have no leave to claim unfair dismissal.

I'm not sure that the OP had a lot option on whether to go sick or not.....I'm sure he would rather have been slop jocking rather than lying in hospital!

You seem a bit vague, you must know how long you worked there... As everyone else said, no real rights here because they can say you were on trial if needs be

We were in the pub trade many year,s it was unbelievable how many Chef,s fell ill at holiday periods it was like walking on egg shell,s with them we started to sack them and it put an end to them ringing in sick

you have to have had warnings for prior problems and their is a set procedure for sacking

Every employee should be in a Trade Union. There is a Union for every job.

2 years is the qualifying period for unfair dismissal.

Even if over two years if as is likely you were on a zero hours contract you weren't dismissed you were just no longer Rota'd to work. Covered as above. Happy 2016

Not so actually.

There are a number of cases where the qualifying period does not apply, eg jury service, pregnancy etc. A sudden serious illness could be argued to fall into this category, but sadly OP, I suspect you work in an industry where if you were to look deeper into this, it would simply reduce your chances of future employment.

You've been unlucky, but pick yourself up, brush yourself off, and move on.

Better luck in your next job.
