Couple of months ago I bought a new van from a showroom that turned out to be clocked 60 thousand miles. Now after a lot of hassle I got my money back.

Anyway, when I bought the van he offered to tax it for me so I agreed. I paid £250 to tax a van I had for one month.

Turns out the guy didn't send the log book off and I wasn't the registered keeper. So dvla won't refund me my tax money.

So I've been calling this guy and every time he lies to me about paying the tax back. Anyway now he has started ignoring my calls.

I've got to the point now where I have lost patience and I'm going to his showroom on weekend to bollock him.

What would you do??

I'm not a violent person but this guy is kind of asking for it right?

His showroom will have cctv though so not sure what to do.

Thumping someone never sorts out your problems

You are more than likely going to end up arrested and charged and in even more shit than you already are.

Your best recouse is to go there and sort it out, tell him you're taping the conversation, and say you're prepared to go to small claims court and local council over the issue.

Violence is never the answer, for the sake of your future is it worth it? Go through the right channels, maybe go to the cab for advice x

As soon as you land a punch on him you lose the high ground, take advice and proceed from there. The CAB can be helpful in cases like this.

If you can proove you paid him and proove it was specifically for the tax then Small Claims Court.

The courts like to see proper procedure followed.

I'd send off a letter demanding my money back via registered post.

Wait for a month (as I'd assume there would be no response and the courts like you to wait 1 month for a response) and then file a claim at small claims court.

If you have proof that he had the money from you report him to the police and explain the complete circumstances, as I am sure he has committed a number of offences of fraud and I am sure your local plod will be more than happy to feel his collar and introduce him to a criminal record.

If you say he's got a showroom, no doubt he won't want his other potential customers hearing what you have to say. Wait till he's talking to a customer, and suggest you both talk it over in his office, in private.

If you have a receipt then do it legally.

Ifyou do not have a receipt :- follow him away from the cctv and punch his fucking lights out.

You have to be satisfied that the damage you do to him is £250 worth.

Then be a bit more savvy next time.

Small claims court is best, but only if you have the required documentation as proof of purchase and that money was handed over for the tax.

If you don't have any of this, your chances are slim. Therefore, if he has a showroom and there are vehicles parked outside, invest £20 for the time a local twat to introduce paint stripper to the bonnet of some of his other vehicles during the dark hours…..

I had just finished my third consecutive coffee as I wrote that and was a little over excited. In hindsight I think a light weight motor cycle may have been more appropriate. I apologise.

Whatever you did then worked, so do the same again.

If you can prove he took the money, and didn't tax the van in your name, I'd have thought that was fraud. Perhaps threatening to phone the police on your mobile, when in his showroom, very LOUDLY (but calmly) might help? Especially if it's busy.

He's not worth anything else.

Park across the entrance be very loud about how he fraudulently took payment for tax when he didn't. (Didn't think tax was transferable now these days anyway)

I would certainly contact trading standards as he may have a track record of doing this..If he has done it once chances are he has done it before and will do again.Also ring Citizens advice or look at their website as sometimes they have the information you need on there.

Does he own the company,if not find out who does via Company House website which lists names and directors of companies.. Any further communication between you and him needs to be documented in case you go

to court, as they will need evidence be it email or letters. Good luck.

I would contact the police and trading standards just for selling a clocked vehicle. Either he was responsible or he didn't check with HPI and all traders check with HPI.

Unfortunately the police wouldn't be able to do anything about the money as it is classed as a civil dispute rather than a police matter so if I was you id take professional legal advice about how to go about claiming your money back.

On the other hand if you can prove that he fraudulently fixed the miles, that could be a police matter. So assess your evidence (making sure there is nothing there that could get you in hot water) and consider reporting that to the police.

Whatever you do don't lose the high ground by using violence as tempting as it is x

Hi thanks for all the above coments, sorry for not replying sooner but work was hectic.

To be honest, small claims is not worth my time for £250 and he knows it. And trading standards was no help whatsoever with getting my money back for the van.

I got the money back for the van cause he knew he didn't have a leg to stand on.

He's not stupid he knows it's not worth my time taking legal action for £250 tax.

The guy has not even apologised once for selling me a clocked van or forgetting to send the log book off. He's a complete ****!

I'm going to his showroom on Saturday to catch him off guard and tell him what I think of him and his business. And like some have mentioned above I will let every potential customer know what he did.

Hopefully I can provoke him to hit me first lol

He did pay a year tax, but he didn't send the log book off so dvla won't talk to me about the van or tax.

So he needs to claim the tax back himself and give me it. This was weeks and weeks ago and he is ignoring my calls.

I honestly have been so patient with this guy and possibly this is why he thinks he can walk all over me.

Yeah at the same time as i paid for the van. Basically cause he didn't send off the logbook (incompetent wander!) I've got no proof I paid tax.

The rules on vehicles taxation changed and if he taxed the van in his name or any other it was both stupid and breaking the law , unless he had a lease agreement with you

He has no case and you MUST not use violence
