Yet another disciplinary

This time for not answering company phone!

Oh and taking a phone charger from another vehicle due to the one I was driving on Sunday not having one in it!

Think I will hand keys back to pathetic boss tomorrow, wait for them to sack me or shall I tell them to shove it where the sun don't shine?

You know the scenario better than any of us - but when it comes to work, I try never burn bridges .

References is one thing, but you know people move on etc. so if things don't work out longer term, going solo - or your minibus gets cricked - you might go back looking for work there.

So leave on good terms, don't give it the big time Charlie routine. Might come back + bite you on the arse

It's quite often the way of the business world though - clients want to work with people they can trust to get what they want done, and the name of company they pay is irrelevant.

They are my customers and only want me as their driver.

They have followed me through 2 other companies, loyal to me.

This is NOT stealing custom from my boss, it is the customer following me.

I should imagine a lot of time would be spent in marketing and advertising, web page and collecting money etc apart from the straightforward part of driving - so if you're starting your own business, have you got that side sorted? It can take time....

I should just say that I have come across plenty of drivers who have customers who follow them and it is never a good situation. I would never take them on in the first place, always plenty of other good Coach drivers out there who won't cause you headaches, and just do what they are paid to do, keep your motors clean and tidy and be happy with the 'whip' if they have done a good job.

Good luck whatever you do. It's not easy running your own business but people will go with who they know and trust. It's a competitive world. Remember though,when your company phone doesn't get answered because the driver is busy,don't blow a fuse

you never know who you might end up needing help or work from in the future"

And you need never know which company owners and decision-makers talk to counterparts in other companies. And management move jobs too, remember.

While I think your a great guy Pez, reading through this post, I get the impression you aren't good with authority?

Each company you work for has rules and regulations that you as an employee must adhere to, even if you don't agree with it, you can express that you don't agree with it of course via the right channels but not following their rules has led to this, like the jacket situation a few weeks ago, they are company rules.

Working for yourself in everyone's head seems quite straight forward but the cost and preparation for such a venture, it's not just get into your mini bus and drive, there is insurances, health and safety, PAYE, training, accounts and I could go on, it takes time to do all these things and while you are sorting all these things out, you are loosing revenue because all the above needs sorting out first.

Starting my own business os something that I have been working on for the last 3 years, I know ot is not easy... plenty of setbacks and other things, hence I am still working for a company.

Insurance and public liability is costly, same as having an operator's licence, premises etc.

I have run a company in the past, so I know all too well what is involved.

Now back to the original post.... not answering a phone because I was DRIVING!

Law's on this are plain and simple, DONT ANSWER WHILST DRIVING and this is the answer I will be giving in the morning.

Who's vehicle was it? Did they know and consent to you taking it? Had you had opportunity to return it and failed to do so? If you have your own coach where was your own charger? Was the charger for your own phone or the company one? If it was for the company one where's the charger they gave you with the phone? Why wasn't your phone charged? Why did you need a charger if it was only going to be on standby as you had no intention of answering it?

If I was representing you in the disciplinary I'd hope you could give a convincing answer to all those questions in order to get off.

Was it a full disciplinary with proper notice and representation for you, or just a "talking to"? If the latter, ignore it and work toward your own business as you see fit. You owe them nothing. If the former - "mind fuck" them and tell them you apologise profusely for your actions, blame it on lack of adequate training and ask them for a re-training course. Also tell them you're under a lot of stress and that you need counselling - see how fast they offer to pay for it

To spy on the drivers? Or to ensure they are doing their job and offer evidence in the case of prosecution and/or insurance claims?

The fact that you refer to it as spying just reinforces the persecution complex you seem to have. I've represented plenty of people in disciplinaries, but I always found bolshoi aggressive unapologetic types the worst to deal with so I'll decline that offer.

I do suspect that if your attitude is as bad as it is on this thread that is why you are on a disciplnary, an apology and an explanation for a matter so trivial usually resolves it. Unless this was the straw that broke the camal's back maybe?

My best friend is a victim, and is regularly subject to disciplinary procedures at work. All she does is whinge and moan about work...no one listens any more.

Some of the replies on here this evening are laughable, nobody knows the full extent of why I have an attitude with my boss, the cctv installed has only been used to spy on drivers, me being the only person in the company man enough to speak out about it.

Others bitch behind the bosses back, I don't do that, instead I load both barrels and shot, re load and shoot again!

So you expect your employer to supply blue tooth for your personal phone (it;s why you said you weren't answering it) incase they ring you on that rather than the complany mobile they supply you?

If the company's too cheap to opt for a legal hands free system for their drivers then they should expect that phone calls will be voice mails to be replied to at the next shedulled stop.

To spy on the drivers? Or to ensure they are doing their job and offer evidence in the case of prosecution and/or insurance claims?

The fact that you refer to it as spying just reinforces the persecution complex you seem to have. I've represented plenty of people in disciplinaries, but I always found bolshoi aggressive unapologetic types the worst to deal with so I'll decline that offer.

I do suspect that if your attitude is as bad as it is on this thread that is why you are on a disciplnary, an apology and an explanation for a matter so trivial usually resolves it. Unless this was the straw that broke the camal's back maybe?"

CCTV is used in PSVs for a myriad of reasons, for evidence in instances of public abuse of drivers, public v public altercations, accident and insurance investigations, external investigations where police may ask the bus company for their hard drives, evidence of damage to vehicles by public, and yes, evidence in disciplinary investigations. It is never, in my experience, used to 'spy' on drivers... that would take up an inordinate and costly amount of time.

Having said all that, from what you have said on this thread, if I were your boss you would have been an ex-employee some time ago.

They probably are not stupid and have worked out that you now intend to set up on your own TAKING SOME OF THEIR (it does not matter that you brought the business in with you when you started working for them) WITH YOU.

What will you do when you find one of your employees is STEALING your business from you when the boot is on the other foot?

Interesting thread.....I saw that you said you have been working on setting up your business for the last three years....during this time the company have been paying you which has partly enabled you to do this so in reality they have helped you. Knowing now that you are setting up on your own in the same industry would be a problem for them which I guess has caused some animosity, and none of us have first hand knowledge of your relationship with your employer.

As many other have said, go with good grace as you never know what the future holds.....also make sure there are no restrictive covenants in your contract which preclude you from setting up a competitive business. Good luck.

But you were happy there before they found out you were setting up in competition. Did you honestly expect them to be happy?

It sounds like you are not quite ready to go it alone and resent her setting the pace. Just go for it, but leave on as good terms as you can - your company may not work out (your last one didn't) and remember, when you are self-employed, you swap one boss for many: because effectively all of your customers are your 'boss'.

It sounds like you work for a taxi firm, in which case make sure you have cctv fitted in your own mini-bus. You'll regret not having it the first time a d*unken customer falsely accuses you of something - I believe in some places it is even compulsory before the local council give you a licence. Not everything is a conspiracy...

If what you have done is by the letter of the law and with in company policy, then you have zero to be concerned about then op. !

Most employers tred very carefully regards any disaplinary and bound by strict regulations .They know otherwise they'd be subjet to unfair dismissal claims.

I feel theres much more to this than just not answering company phone while driving and would be a totally different story coming from the other person's side .

We will never know the full account but whether you are in the right or wrong best to go in with dignity and grace

Sounds like the OP is using the company as a stop-gap until he's able to use his own Minibus and set up for himself, taking some of there customers with him.

If I was him, I'd grin and bear whatever they threw at me and leave with without being sacked.

And, as for taking another job - this may not be that easy if they got wind of him only wanting the job for a short while then leaving; if it's the same work he's doing now, they could even be concerned he'd take some of their custom too.
