So in the metro this morning was the story of a 24 year old woman who posted explicit photos of her girlfriend on Facebook. She received a suspended sentence and basically got away with it. Do you think a man would have seen the same lenience?

A suspended sentence isn't the same as getting away with it but I can see your point. However prisons are full so maybe a hefty fine, hitting the pocket is often a good motivator.

I guess it would depend on the specific circumstances, and rightly so.

In exactly the same circumstances, other than the accused being male, I don't see why the sentence would be different.

Indeed. She'll still have a criminal record which she'll have to disclose in certain circumstances and it may cause her all sorts of future problems.

Very true, the only issue with giving a suspended sentence is it's hardly a deterrent, I also fear they have now set a presidence by only giving a suspended sentence.

What if the victim thought they were just images for personal use?

Is the onus on us never to allow such images to be taken or on every one not to use other people's photos in such a way?

I'm not asking in an argumentative way, just thinking out loud

I'm dealing with a case currently around this subject, obviously not going to discuss but it is noted that a nimber of these cases are due to the victim being in quite a controlling relationship.

He was the first person to be convicted of revenge porn according to the local news. Sentenced to 6 months suspended, 4 years restraining order, 100 hours unpaid community work & £300 costs.

It's still a conviction.

Of course they haven't set a precedent, except for cases which are very similar. Other cases will be tried on their individual circumstances.

That is a pretty tight sentence I think the judge got it fairly right with the sentence.

I'd consider a criminal record a deterrent, even if I "only" got a suspended sentence, a fine and community service!

Having a criminal record can impact ability to get some jobs, ability to get a mortgage, loan or credit, insurance and all sorts. There's also the embarrassment of having to declare it on various applications and in certain circumstances.

I'd consider it a deterrent, without a doubt!

This young lady got 6 weeks suspended for posting and 2 weeks for assault.

I personally don't agree with that but I wonder if people realised how far a criminal record is likely to impact on their future, they might consider their actions more carefully. Unlikely I suppose.

I think in cases like revenge porn people act rashly and do silly things (not all cases I grant).

There is also the risk that someone (I.e. Single male) with photos of someone else on their profile could be accused falsely if the other person turned against them. Just a thought.
