Pivate copying of own media, The Law vs The Government vs The Music Industry.

Back in October 2014 the coalition government made it lawful to "copy" and/or "format shift" one's own purchased media for personal use. About time, good thing and all you would think.

Except the greedy bastard "Music" industry*** thought otherwise and challenged the matter.

The High Court agreed that in essence the Govt ( despite ruling on 5 of 6 items in their favour) acted unlawfully in doing so and have allowed a juducial review into the matter.

For anyone who is interested, the published Judgement gives a fascinating, if lengthy insight into the whole various processes of creating European and National legislation.

Google for "baailli, [2015] EWHC 1723 (Admin)" Or pm for help if struggling to locate.

Paragraphs 18 and 19 are particularly relevant.

*** re greedy bastard Music industry.

In a recent German case, GEMA (the collecting society) demanded 37.5 euro cents (about 25p?) for every single view of any youtube video featuring their artists. Shame the Judge is not allowed to tell them straight "Fuck off, case dismissed." The above bailli case shows why not.

Does this mean someone official is going to come and look in my car for any homemade CD's I may/may not have made due to the fact I wasn't allowed to add (as a zero cost option FFS!) a friggin iPod input socket to my company car?

Should I fire up the barbie and nuke the things now?

Or should I not worry and just go "Meh!!"

I doubt the music industry will be suing individuals who have purchased the original tracks and just want them on more than one device. The damage is minimal, the cost high and it wouldn't help their reputation. File sharers are another matter. The reality is that this is a non-issue.

A non issue? It demonstrates precisely why the UK's administrative processes and burden is so costly and time consuming, by a magnitude over and above what it should be. Which Joe Public ends up paying for.

The music industry agree re individuals, the ruling is clear that zero or de minimis harm/damage is suffered YET the industry won't allow the October 2014 legislation to stand. For no possible gain to them.
