Whoever is wearing the ring, it's their decision what to do with it. It's a gift... You wouldn't ask for a birthday present back after you split up with someone would you...? x

I would have given mine back if I'd had one, or given it to my daughter like I did my wedding ring. In cases of the ring being an heirloom or no children to hand it down to I would say give it back as it's a symbol of a joining together.

In the UK legally it's classed as a gift so doesn't need returned. In the US though most states class it as something that was only given if the wedding takes place so a broken engagement usually means they don't keep the ring

Quite interesting.

I have an engagement ring from a fiance who cheated on me. Never worked out what to do with the blasted thing since and that was about 10 yrs ago

I've kept both of mine. I still wear them sometimes.

I think if the guy was still paying it off then he should get it back as it's cruel to make him continue paying for something after you split. Or at least offer to pay the rest yourself if you wanna keep it.

If you subsequently get married though then I'd say - entitled to keep it. My mum advised me to sell mine. I still have it somewhere, but am thinking of selling it and buying a piece of jewellery I would wear.

Unless there is an implied or express agreement that the ring would be returned (and implied can be complex), then the ring is not returnable.

Why you would want to keep it is a different matter.

Speaking as a guy id be pretty miffed if we split and Mrs dpt smashed the ring or threw it away.

I spent about two months of planning having it made choosing the design and viewing diamonds to go in it....was a lot of fun

Plus there's the fact it's worth a fair bit. So if she would throw something worth a few thousand just to spite me, yeah that would piss me off.

I'd much rather she kept it or sold it or better still gave it me so I could sell it

Agree. It's a symbol of the agreement to become engaged and to wed. It's not a gift in my eyes.

I think if it was bought for me I would keep it. Unless it cost an absolute fortune, in which case I would sell it and split the money. If, however, it was a family heirloom I would give it back. Just because it didn't work out with me doesn't mean his granny's ring or whatever with the emotion and history attached shouldn't go to someone else. My mum has three. She kept them all (mind you she married and then divorced two of the givers) and had them resized or turned into other pieces of jewellery.

It should be given back. I'm sure I saw a court case where the women was forced to give it back because it is not viewed as a gift but more as a payment of contract, marriage. This maybe utter bs so long ago I cant remember all the details.

It depends on the reason for breaking up. If he finished it, she keeps the ring, of she finished it, give the ring back. If it's a mutual decision she could give him the money or the ring.

In Britain, if the man ends the engagement then the woman is usually entitled to keep the engagement ring. If the woman breaks the engagement then the man is legally entitled to the return of the ring. However if the ring was offered as part of a gift, for example on Christmas day or Valentines day then it will be seen as a gift and does not need to be returned. Each case is different and it will usually be left to the couple to decide who keeps the engagement ring. The engagement ring is usually seen as an unconditional gift in the UK

That's how I've always thought of it too, and the woman takes it off and throws it at him when they split up. (Though admittedly my only experience is from Holywood films - and some of them aren't totally true to life)

Surely keeping it would remind you of someone you wanted to forget?

Why not? It depends on the circumstances of the split?

I kept my engagement and wedding ring, decided to sell my engagement ring (after my ex-husband had remarried), but have my beautiful scottish gold wedding ring still which I haven't quite decided what to do with it... and as scottish gold, its rather a nice investment, so may well keep it and give it to my son when he is older.

we aren't together for various reasons, but I still have some of the other gifts he gave me too - like the pyrex dishes he got for my wedding anniversary, or the digital car tyre inflator I got for my first christmas as a mummy.
