Just received a "Parking Charge Notice" from ParkingEye for staying more than two hours at Fleet Services (I had worked all night and fallen asleep). T'internet suggests an appeal is often successful when dealing with these private firms, does anyone have experience of appealing these things?

google you-tube " parking eye" there is a guy on there with several you-tube vids about taking on various parking fine companies and bailiffs. he is a para legal and puts the shits across them and records fone convos and posts them on u tube. absolutely brilliant stuff

Very much doubt you can argue with it. Your best hope used to be to argue that they only had a case to charge you for lost revenue ( 2xhourly rate), but a recent test case put that to bed.

I managed it, only because I put in the wrong reg in the machine. The reg of my other car, which was at home. They allowed this as an honest mistake and I hadn't overstayed the time on my ticket.

They can't enforce payment without taking you to court.

Then they can only claim for their loss. Parking is free for two hours, then £5-00 an hour.

You owe them a fiver.

You still don't have to pay unless they enforce judgement. Until then pay nothing, you won't be clamped, or towed away.

I had one at Lidl, see previous post, and heard nothing since January.

I had another at Moto Services Exeter, I just had to sleep, and overstayed, a couple of years ago, again heard nothing.

It's all pseudo official Crap designed to make you cough up. DON'T.

If it's from the Council or Police, different altogether, pay asap or they'll have the shirt off your back.

Parking companies are scumbags like pirates.

Send them a postal order or cheque for the cost of an overnight. They'll leave it at that. If you want an idea of text, DM me and I'll give you what I sent. Never heard from again that was with welcome break. Even if you're a few days after, call the truck stop and speak to the manager, they'll let you pay the night rate. I just done this with Abington.

As someone that collects parking tickets on a regular basis i find that the private parking companies will pursue you like a jack russel with a wasp in its mouth!! if you try to avoid or argue with them .

Make a POPLA (or Parking on Private Land Appeals) as the fine is based on breach of contract anfvtgeyre charging you to much. Just goggle POPLA (other search engines are available)

Begs the question of how they make money though.

I'm guessing the amount of people who ignore these private firms is quite high.

The only ones I actually pay are the council ones, because they really do nail you as I've found out several times.

Sorry, but this used to be the case, but if you do a web search you'll see that Parking Eye in particular, are taking people to court, and judges are awarding hundreds of pounds compensation to them. This change started a couple of months ago - when was the last time you tried ignoring one?

Test case in the High Court - judgement given at end of April - appears to favour Parking Eye. sadly!

Fight is not over as Beavis may be taking it to Supreme Court .

You can only appeal to POPLA after you appeal to the issuer if they reject your appeal not sure about parking eye but most of them you can ignore it cost them more to pursue you than it make financial sense to carry on for to long, some companys now make bulk request to the small claims courts though watch out for them

Local authority parking fines you must pay. Got stung in Stoke once ended up paying 500 for a parking fine and they were within there rights. I would personally pay even though they are a private company knowing you outstayed your time limit. Should be half price if paid within 14 days

This is no longer true so for your own financial well being, do not follow this advise.

Parking Eye are taking people to Court in ever increasing numbers. They have had plenty of time and experience to get their methodology right and unless you follow exactly the requirements of POPLA you will not have a leg to stand on. You will get taken to court, you will have to pay the charge as well as their and your costs.

If you have any doubts check your local Court and see just how many cases now involve Parking Eye.

Had exactly the same, look on the parking forums that have been mentioned already.

I used the template letters asking them to justify how I had incurred their costs, being that it was 2 am and the car park was empty Etc.. They then threaten court, just sent letter back again saying I would be happy to put my points forward in court. They gave up in the end. This country is a joke considering that there is an safety advert on the radio telling drivers to pull in at services if tired, have a coffee and a nap then carry on your journey. Whilst at the same time passing statute laws to enable these vultures to continue praying on motorists.

They managed to get law changed so they can now just fine the owner of the vehicle for not telling them who was driving. Before the owner could not be pursued if they ignored the letter.

Obviously some Bent politician was paid to get that one through!

I've had that before.

I was knackered. Pulled over into the services fell asleep.

Several weeks later I get letter through my door and a fine.

Ok. . So I should of carried on driving then? .. wouldn't want the risk of pulling info The services in case I take a nap which is exactly what the sign is telling me to do. ..

. These parking ccmpanies ensure that there are spaces available for those who obey the various regulations . I am unsure as to why people think they should be able to ignore the rules .

If it's your car then just wait for the notice to owner to arrive and take things from there. The paperwork is probably flawed. In the meantime go to pepipoo and browse.

Don't ignore things though. Things have recently changed and ignoring is old advice.

I took my mum shopping at christmas last year to Stockport,entered the car park and drove around and it was full so left under the barrier.Two weeks later an £80 fine dropped on my mat saying id parked without paying.Rang them up and asked for the pics off the cctv as proof and heard nothing back.All shisters out to rip us off,dont give them f all

Sod off. They don't, but perhaps they make a mistake, get it wrong, whatever.

Let it go to court, then at least your case will get heard with an impartial Bench that aren't paid per ticket.

Murder someone, and your mitigating circumstances are considered.

Get a parking fine and it doesn't matter if you can't read, we're having a miscarriage, or were abducted by aliens.

If the parking is free for two hours, you overstay by ten minutes, whilst using the facilities at the Motorway Services, and

spending on fuel, eating in the restaurant,buying Crap in the shop, oh! And stopping to sleep so as not to cause a multiple fatal accident on the Motorway, which then costs millions for repairs and medical bills and compensation claims,

I don't think a so called fine of £80 or £100 is fair,or reasonable,or represents any loss incurred by the land owner or business thereon.

Neither does it take your ability to pay into consideration.

Let them take you to court. They never will.

Of course none of this applies to you, because you are such an effing Saint.

There's nothing they can do. The earlier post saying council and police are the only ones that can actually charge you. My dad got penalised on aldi car park. He paid. Then found out that you can just ignore them unless it's from council or police.

Just an update on this. I appealed through POPLA and they found in my favour - official wording was "...the Operator does not have the authority of the landowner to issue parking charge notices".

Hopefully they will get authority to issue tickets asap. Parking spaces are usually only available because the majority of people adhere to the regulations and traffic wardens / parking attendants do an excellent job in ensuring that these spaces are available for us

Seriously annoys the 2HR free at services, the whole idea is to provide safe rest for people travelling and tired to aid not driving tired,

So they put extortionate parking charges on the services which only deters people from using them,

Rather pull off the motorway and find a side street, I refuse to give them a penny

The future of these scam invoices will be decided in the Supreme Court where ruling is awaited in the case of Barry Beavis vs Parking Eye. A lot is riding on this one.

DO NOT ignore them.

The rules changed and they CAN and WILL take you to court.

Parking Eye have done so successfully.

The POPLA appeal is the defence you MUST use.

They will refuse your appeal - it's their company policy.

They are legally allowed to charge for quantifiable loss - ie what it cost them for you not paying.

A free Car Park hasn't cost them anything so they have no loss.

But don't ignore them - they have the law on their side now

"Only the local authorities have the ability to 'fine' you for parking infringments (police, council, traffic warden etc).

Private companies have no legal right to do so and you're not obliged to pay or admit responsibility. Ignore all letters or correspondence regardless of any threats.

DO NOT ignore them.

The rules changed and they CAN and WILL take you to court.

Parking Eye have done so successfully.

The POPLA appeal is the defence you MUST use.

They will refuse your appeal - it's their company policy.

Exactly. Which numbnuts actually pay to park these days. Daylight robbery. I have a rule, if they expect me to pay to park somewhere, I won't go there.

Most agents don't have the clout to back up their threats and rely on the threat itself.

Parking Eye are part of a massive group and have the backing of their own legal teams.

They have won in court on several occasions.

As always - Pepipoo is the best place for up to date info for those not dealing with it day to day.

I get a parking dispensation for one town near me all street cost £25.00 a year despite on staeet parking £1.20 a hour and another town I just appeal them .

Never get a ticket if I display my parking dispensation for the neighbouring town

Never park on private land except when workin and stick to their rules

Jobsworth at the council always let parking ticket appeals through private companies usually don't

Appeal it and then pay it if you don't win appeal

It soon turns into 400 odd quid for a 30 fine

If you let them take you to small claims court they have to prove it was you driving being the registered keeper doesn't automatically make you liable.
