A man known as the "naked rambler" has had his final appeal to be naked in public rejected by the European Court of Human Rights (ECHR).

Ex-Royal Marine Stephen Gough, had argued his repeated imprisonment breached his human rights.

Gough, 55, from Eastleigh, Hampshire was refused permission to appeal to the ECHR's highest Grand Chamber.

He first gained notoriety in 2003 when he walked naked from Land's End to John O'Groats.

Last October, he was jailed for two-and-a-half years by a judge at Winchester Crown Court of breaching an anti-social behaviour order (Asbo), involving walking out of the city's prison wearing only his boots and socks.

do you thin it is offensive or right to jail him?

He had previously argued there was nothing intimidating about him appearing "in his natural human state", and had served a previous jail term for the same breach.

He was arrested several times.

There was a rather sad programme about him last year. His family have really suffered in the loss of a father, son, husband because of his behaviour.

It is not illegal to be naked in public. He has been locked up for 7 years at a cost of over 250000 pounds. If he had raped kr murdeted somone he would not have served that long.He has not commited an offence as such. Itsonly peoples reaction to him that gets him imprisoned.

Just as it's not illegal to have sex in your own home with the curtains open. However, if someone sees you and is offended then you are in the wrong.

Totally Agreed

In saying that though he's being a knob and is asking for it. The law is the law, as shit as it is.

I like being naked outdoors too but if its going to get me in trouble or offend folk I'll respect that and do it in an appropriate place. Nudist beach/area or secluded spot away from prying eyes.

Maybe one day we'll be a freer (is that a word?) more open-minded society.

He's shown himself to have nothing to hide nor be a danger to others, unlike many high profile people who were hiding and had their wrongdoings kept hidden.

Feel like he should be given the equivalent of the keys to the city for the whole country and ramble away.

It's a pity the European courts couldn't have found in his favor.

We are an odd species and an odd country when it comes to nakedness and our acceptance of our own form.

We have have 'Page 3' shots in our newspapers, but ladies cannot go topless in the streets despite campaigns to de-sexualise breasts. We have internet awash with porn; teenagers parading themselves all over Kik & Snapchat. Yet cannot get naked in the 'Big Room' except for designated areas (and there are very few of those).

Its a dichotomy of thinking and a contradiction in terms. Society (as a generalisation) is both appalled and titillated by nudity at the same instant.

I did watch the documentary of him oh the tv awhile back and he struck me as a troubled individual but a harmless one!.

I wouldn't be offended if I was out walking and stumbled across him, even if I was with my kids,I can't possibly see how a dangling dick could scar a child for life!.

I'd certainly be more concerned about what they can see over the internet!

yes i saw that to.its on youtube if any one wants to see it..his partner on the walk was my ex girlfriend ..who felt self conscious going topless on the beach a few years before when we were together..not sure how he persuaded her to do that walk but it was an amazing feat, even with your clothes on.he's been locked up ever since.they didnt quite make it to the end

I think it has to do with where you are. Topless on a beach is considered to be ok, topless in a city environment not ok. It might not be illegal to be naked in public, but there are decency issues there as not everyone wants to see you naked.

decency has nothing to do with the amount of clothes you wear but in how you act.

What about the naked bike rides carried out in many cities? Nobody gets arrested as it's not illegal to be naked in public in the U.K.

The only issue for kids with nakedness is from parents' - we learn embarrassment and shame.

We'd be a lot happier as a nation if we got over our recently developed increase to moral outrage.

The guy's obviously not someone who does anything in secret, has no ill intentions, he's open about what he does and his motivation.

My personal _iew is nudity in public should be regulated

However it is only the way our western society is orchestrated that means some are conditioned to find natural human nudity offensive

The naturist argument is valid

That the body itself is not offensive or showing it an act of sexual molestation or offense these are results of prudish conditioning

However we are within a conditioned established community and the feelings of the majority conditioned are worthy of consideration

I don't really agree with our friends approach to raising consciousness , but he has some valid points about all our freedoms

But as repeatedly said above

Just like Alan Turing he broke the law end of and should be punished severely

Being naked is not against the law but can turn into a 'breach of the peace' and the like.

His biggest issue with the law is not keep to Judges orders, which then results in him being found in 'contempt of court', which I 'think' is a fast-track to prison. As he continues not to abide by court orders, so the problem compounds.

In some respects I totally agree with the bloke, but I'm also of the impression that he's totally bonkers.

Been a while since I read his story but I think its all added up. Get's arrested, appears in court 'naked', told to get dressed, refuses, gets a few days for contempt of court. Reappears in court 'naked'... and so on.

Goes to prison, does his time and leaves the prison 'naked' - 'contempt of court' - rearrested and so on.

How Many Years in Total has he been in Jail since 2003.. ???

I can remember that He Did Spend a lot of Time in Scottish jails Before they Decided to let him Walk over the Border to England..

He must be costing the tax payer a Fortune..

Totally irrelevant because the guy hasn't committed any crime as such, he's 'only' broken the law

When he did his walk he only had just a little bother in England. He was arrested maybe 1, ,2 or 3 times but then un-arrested and sent on his way.

When he crossed the boarder into Scotland, that's when it all changed and got serious.

In England public nudity with ZERO sexual content is not illegal as such. But if people complain then it can be classed as causing 'a breach of the peace'. For that you can be arrested and I'd guess, be held to appear in court.

I don't know if the law is different in Scotland or just applied to the fullest extent.

Personally I think they are criminalising someone who maybe needs some psychiatric help. But most certainly needs a Manager, a Public Relations Manager, and a Campaign Manager

Frankly I think he's a fucking arsehole. The law is the law and whether we agree or disagree with it, it is there and has to be adhered to. This guy has obviously broken the law and acted with utter contempt for the law, therefore he needs to be punished in accordance with the law

I personally think two and a half years is a bit steep

When you think that catholic priest only got three

How do you justify a man who abused his position of trust and abusing children for years only getting 6 months more than a guy who just walks round naked

I'm not saying what he's doing is OK or he should get away with breaking the law but they seriously need to sort out the justice system

Right....so he is found guilty of breaking any of those laws depending on where he is being naked. So the law is the law lol just because there isn't a law about being naked doesn't mean he isn't breaking the law by being naked.

No it’s about how laws are bent to suit the situation.

There is no specific law in Scotland where he keeps being jailed.

Outraging public decency if a group of people decide among themselves that they are outraged by the word GREEN if someone uses the word GREEN they can then claim that the use of the word outraged public decency and the offender could be jailed up to 7 years for the use of the word.

Note I have deliberately chosen an extreme example.

What this means is there are no set rules in these common law cases it depends what "the public" decide is a breach at any specific time or place.

In other words a member of the public has been put in a state of fear or alarm.

The prosecution to prove this intention to upset to get a conviction.

Under English law there is still no offence of being naked in public but there are three other laws used to bring actions.

Indecent exposure - an offence under section 66 of the Sexual Offences Act 2003

Intentional harassment, alarm or distress - under section 4A of the Public Order Act 1986

Outraging public decency - under common law

The last of which could be used to charge all on here who use swear words, just a thought.

Just because something's 'a law' doesn't mean it's 'right'. Some country's have crazy law's. I think as human being's we know in our hearts some law's and there punishments are just plain wrong.

There is a phrase in law that says 'The law should be applied in the SPIRIT of the law'. That is supposed to protect people from prosecution where a law may have been broken but no crime has taken place. Such is the case with the Rambler, while it might be construed that he has 'technically' broken a law, he has not actually committed any crime.
