Barebacking without consent

Just to clarify, I believe Mr Cracken is right. There was a time when the worst barebacking could have got you charged with was assault. However I believe, after Julian Assange, the Supreme Court ruled that bare-backing without consent is indeed rape, which is why he is where he is....

Without video evidence etc - difficult to prove that consent to bareback didn't take place? Unless there were multiple witnesses of course! Xx

Swedish law yes, but to enable him to be extradited they had to consider the implication under UK law.

Indeed. If the consent given had conditions attached (eg must wear condom) and those conditions were not fulfilled, the consent is invalid.

There was an example somewhere....

In the case of Mr Assange, the UK court found that since the lady in question had made it clear that she would only consent to sex if he was wearing a condom, this constituted 'conditional consent'.

Thereby, without a condom there was no consent, hence he could have been charged under UK law.

Quite right, removal of a condom when that is the basis on which consent has been given is a violation.

Not under UK law no, since technically it is the disease, not the person who kills.

However there are a number of applicable charges, at least one of which carries a potential life sentence.

(Assuming the carrier knew they were a carrier)

no... however there have been cases in both england and scotland where people have been charged with in effect Grevious Bodily Harm (GBH) because they have not told the person they had slept with that they had hiv.... its comes under reckless endangerment (sexual transmission of HIV)

In my view the then the male would know and should jump right off so that the female then is aware of it. After all it's the male who wod feel it first. Like everything make the rules and limits before playing and just be honest and upfront, after all we are all adults and know these things do happen
