right i got a letter today, some shit about i put a load of boxes and stuff on a street and i now have a £75 fine down to £50 if i pay in 10 days, however the time and date on the form i can proove i was no where near the area, i can only assume they saw my address on something and then added a day and time? i aint admitting nothing, i might have done it, i might not have, how i do find out if they got camera proof or something before i try to appeal?

Sounds silly, but are you sure it is actually a council raised charge, and not some shark trying it on?

Sounds like this is a great way to get revenge on someone, dump a bit of rubbish with their address on and get them fined.

Found the following on LocalGovernmentLawyer website

"The Local Government Association wants local authorities to be able to take action against the registered keeper of a vehicle from which rubbish is thrown if no one will admit to being responsible for the act.

The current position is that if a council officer reports litter being dumped, a fine can be sent to the keeper. However, if the registered keeper denies the offence and no one else comes forward, the local authority must then prove in court who was responsible for the littering.

“Such a difficult and expensive process means most councils cannot pursue the case, especially as past court penalties have been less than the original fine and the defendant was not ordered to pay costs,” the LGA said.

The association added that offenders are generally only fined if the vehicle is stationary and the littering is seen by a council officer who immediately issues a fine, or if they admit to it on receiving a fixed penalty notice by post."

If you have clear proof of being away, and are sole resident of the property, then a council is likely to back down it seems.

I dunno.....I suppose it would depend on when it was reported dumped to them picking it up. If it was reported dumped and picked up on the same day as you can prove you wasn't there, then I don't see how they can charge you......but.....if it had been dumped a couple of days before being picked up by them, then they could say it could have been you.

Your posts imply it was you but your not going to admit to it, either way someone had access to your waste

I think the courts will doubt that someone stole your rubbish to dump elsewhere, go for the lesser fine.

Whilst council employees can be all colours of expletive, did you really ought to be discussing a legal case in open forum? Unless said ticket writer is on here... And you can come to some sort of arrangement...

Perhaps Citizens Advice might prove more helpful.

You could be stuffed here..........

Ask the local authority what proof they have to send you the charge as they will have it. Illegally dumped rubbish creates all sorts of problems all over the country and if its traceable to a name or address then the council can pursue payment for having to clear it up, even if you'd paid someone to take it away and they had illegally dumped it your still responsible and can still be charged in the same way as if someone dumps rubbish on your privately owned land you may be asked to pay to have it cleared.

if it was you then pay the fine fly dumping now is a disgrace when theres so much resycling facilities in order also helps keep the country tidy if everyone was just free to go dump stuff imagine what we would be living in oh and normally with the letter being sent out they will have proof normally car registration caught on cam or a passer by thats reported it happening .dig deep and pay up your as guilty as charged

lol no but my brother lives down in London and they have regular run-ins with the authorities over this kind of thing.

You can even get a fine down there if your food recycling bag is put out too early as they have problems with urban foxes.

Plus I know someone who tried to do a thing like this with a speeding fine and got a letter from the authorities saying "Are you SURE it was you driving?" with a photo attached. Ooops!!

Pay the fine and don't do it again I say.

Under the Data Protection act you are entitled to see all the data they hold about you. Throw that at them and say you require all the relevant documents an that failure to comply will be a breach of this act and you will have no alterative but to report them. It does sound like a scam though and may be worth contacting the police I'd tell them that as well.

I think you might find you have been send a fine under they fly tipping act. Councils are entitled by law to charge someone for rubbish collection dumped in any place other than and authorised Rubbish Dumps/recyling centres. The will go through the rubbish to find out any information about who it belonged to and that person is liable.

Remember that whenever someone fly tips the councils have to pay to clear it up. This comes out of your council tax which we all pay for and helps make our bills more expensive.

So as far as I'm concerned if you fly tip and you get caught. Tough.

The council aren't in the habit of plucking a name out of the address book and lobbing a tipping fine at them. They have this quirky little thing called 'Procedure' and they all have to stick to it.

So, I imagine someone from the council found some rubbish that had a name and address on it, let's say it was a Wednesday that they found it, but the rules say that the fine isn't levied if it's dumped on the day they found it, so a fine is issued on, maybe, Friday.

The person getting the fine is the one who dumped the rubbish so they gotta pay up. Obviously, the smart person would have taken any identifying labels off the boxes before dumping it.

Suppose its OK, the council will come and collect it eh, after all thats what we pay them for I guess? Lets hope that the kids start having a play with it and scatter it all over the street so the council have to spend even more time clearing it up eh? Cos they have nothing else better to do eh?

Maybe the fine that you have to pay will partly pay for the council staffs wages and transport costs to clear up your mess... after all, I assume you dont want your fellow council tax payers to have to pay more do you?

I was caught on CCTV and had to go to the council office and do an inter_iew. They showed me the video evidence in the room. They caught me in my works ven putting some wood at the areas recycleing banks and got done. If they do have you on camera they would of said. I reckon they just got old letters. Just say you rang up a garden clearance man who took your old stuff and dumped it there. You paid him so far as you know he took it and disposed of it legally

Makes no difference if you paid someone to clear it, Unless you can provide a proper receipt from a registered clearance company. If not then your still liable for your rubbish.

I worry at times how parts of society have collapsed.

Rubbish has been dumped, they have evidence tracing it back to you most likely because you have ditched stuff with your name and address on. (with id fraud it’s a dickish thing to do anyway) you as good as admit it and then look for a way out by asking on here!

Well your not going to win any IQ tests for one, secondly your actions have caused a paperwork trail and thirdly what’s wrong with getting of your lardy arse and going to the council tip? Laziness, lack of intelligence and a total disregard from others comes to mind.

Quite incorrect if you care to check the facts. On neither occasion was someone not working stated. One was an issue of manual labour being a good cure for insomnia. Reading things fully does wonders for understanding things.

Answering the initial post, I would suggest that of they do have cctv footage of the tipping, then it can only be to your benefit as it will absolve you of all blame...if, as you state, it wasn't you.

If it was you...unfortunate, but you have to pay the fine. To me its a greater crime than speeding, which most folk will hold their hands up to and pay.

I live in the country and find any kind littering a total abhorrence. It's not just unattractive, but potentially harmless to wild life.
