Since new rules came in it's entirely your own responsibility, unfortunately.

I have it in writing and it was the dealership. We paid them to tax it so we could drive it away as I know its not sold on with the car now.

Since they changed the rules, the new owner has to tax the car, road tax is no longer transferable

If that's the case which I'm not saying it isn't but how do you drive the car home!

Dealers can still tax a car on behalf of the buyer I think, tax just isn't transferable anymore.

I would be gathering all my paperwork, making an appointment to speak to the manager of the dealership and asking for my money refunded along with all your costs incurred in doing so.

This is true, dealers can still tax the vehicle in the owners name, bit pants that the dealers have done this to you though

And make sure you make it clear that if you receive a fine they will be paying that as well. As far as I know that will come through separately.

It's actually illegal for a dealer to let you drive a car off their forecourt without any road tax, ask any dealer they will tell you the same.

Exactly...that is the question now though, how do you know they have bought it? I don't think there is a tax check like there is an MOT check?

You can check on dvla website, if a car is taxed, no good after the horse has bolted though.

You can check whether a car is taxed, MOTed and insured all online

With regards to checking tax online, the website can take up to 5, yes 5! days to update itself!!

Just be aware, there have been cases since the new rules came in October where dealers have taxed cars on behalf of customers only for the DVLA to refund them to the previous owners! This would only come to light where the previous owners contact the garage asking why they have had cheques back from the DVLA.
