WARNING: This profile either in its entirety or any part there of including photographs must not be copied, quoted or used by any person, institution, company or agency. The content of the profile remains my property both real and intellectual. By posting this profile I do not waive my human rights to privacy under article 8.1 & 8.2 of the European Convention. Legal action will be taken against any party who attempts any breach of data or violation of my rights

If you copy this disclaimer from another profile to put on your profile, are you now in breach of said disclaimer?

Good point, that disclaimer isn't worth the paper its printed on

It often makes me laugh when I see such disclaimers. There's been a fairly recent frenzy on other site too where people have been quick to copy and paste something that they haven't actually examined or considered fully - or looked into the actually legality of such statements - they just re-use it under the false belief that because someone else has posted it, it must be legitimate.

Let's just look at what is being said in OP's disclaimer (Yes OP, I do realise that this was intended as a humorous post )

Specifically let's look at the sentence ' I do not waive my human rights to privacy under article 8.1 & 8.2 of the European Convention. '

Anyone actually LOOKED at the Human Rights Act? Anyone actually familiar with Article 8?

OK, so here we go then.

Article 8.1 - Everyone has the right to respect for his private and family life, his home and his correspondence.

Article 8.2 - There shall be no interference by a public authority with the exercise of this right except such as is in accordance with the law and is necessary in a democratic society in the interests of national security, public safety or the economic well-being of the country, for the prevention of disorder or crime, for the protection of health or morals, or for the protection of the rights and freedoms of others.

I'd like to know how someone copying something I have posted on the Internet and in THE PUBLIC DOMAIN in any way breaches this part of the legislation.

Simple. It doesn't.

Totally agree.

To cover the other aspects, someone somewhere has written this statement and put it in the public domain. Therefor arguably it is their intellectual property. Others have copied it, thereby an infringement that the statement itself is supposed to protect against.

Legal action? You stole my pics/words etc from a swinging site therefor I will take you to court on the basis of sone legislation that doesnt apply in this case.

Not even Judge Judy would touch that one...
