Is streaming piracy?

I was pondering...

If someone uploads an album to YouTube and you are just listening to it, (not recording or downloading it), are you a pirate?

The person who uploaded it is, by sharing copyrighted material, but isn't it then in the public domain?

(P.s. this is a hypothetical question)

To me, it's no different to listening to a friend's CD or watching a DVD they bought.

If you were taking a copy, yes it would be piracy.

streaming down to your pc is not piracy as this is what the big companys want to do by using the torrent network

however uploading the file is for other people to view or listen to it and you get a take down notice or the isp does

if you own your stuff you can legally do digital copys for your own use

Youtube is ruddy useful for checking things out before you buy. I wish I'd checked out Tony Law before buying tickets to his show, though.

Even if you've purchased an album, you can't even use that music as background in your video without their permission (well you can but they'd be entitled to ask you to remove it or sue you).

It's a bit more complicated than this when it comes to short clips or educational content but basically you can't claim anu=yone elses stuff as yours or use it as if you own it.

Which is why youtube is strict on the content of what is on videos on their site, they can be sued or shut down as well as it's users be in trouble.

Obviously there's so many videos on youtube alone that it's impossible to go through them all, which is why the site has disclaimers and report features and staff who remove stuff. Samr for other sites, but there are ways round these laws as well and certain countries don't have the same laws as here or the US so that helps too.

Public domain doesn't apply to copyright stuff. And just because you upload copyrighted material it doesn't change that fact.

specifically to youtube, they reached agreement with music publishers that allows music to be posted on their site for the purposes of streaming. the agreement means that when you watch a streamed video with a soundtrack you will see adverts at the begining on during the stream. the revenue from the advertising makes up a dividend which is paid to such organisations such as PRS etc. if an upload infringes copyright then it is removed by youtube extremely quickly in most circumstances. so no, it's not piracy.

Youtube do because you often get a 'copywritten' type message up and it wont play in 'your country'.

Never had that... maybe because I hide behind a vpn, that allows me do access download sites that are blocked by court order..

I use proxy's for downloading but thats about it.

It's annoying that for tv shows you have to go to 'c4 on demand' for eg and put up with the adverts
