"Surely if it's your wagon you would be the one responsible for checking it's safe and that the pins were there?" we use different wagons everyday plus no one ever told me in ten years off working there that we should be using pins .

"If you are going to be find in a day or two, lesson learnt. Did you need any first aid, there and then? Time off work? Were you doing all the right things, up to that point? Have a look at your 'first parade' checklist for the vehicle, does it mention checking the pins or load or similar, then you didn't.... Is it worth what you are likely to get, for the bad feeling it could cause? " had to go in ambulance to a&e . Dr at a&e told me not to go back to work that day but be ok day after . It happend at 8 am .

"Was it recorded in the accident book? Reported to your Health and Safety officer ? Were there witnesses? Most companies have a set procedure for accidents at work and investigating whether the company would be liable. " And that is upto the company to investigate if they wish, not him as an employee, he was injured at work, he can claim for it, its upto the company to prove they arent liable not him to prove they are.

" You're supposed to check your vehicle is safe daily, aren't you? As for not knowing, that is negligent on the part of the company.

"1, have you reported the accident 2 it's your responsibility to make sure it is recorded in the accidents book 3 remember good house keeping is the responsibility of all not just the company, and by that I mean knowing about your responsibility as a Driver 3 fill in a claim against the company, these should be held by the HR dept 4 don't feel that's it could cause problems at work just because your making a claim Good luck " the ironic think is the accedent happend at another one off our depots and the head off hr was there and came and was one off the people to come out to see me . So she sore all the blood etc .

Should of taken a few days off, and ask them to adjust your record so the days off is recovery and not sick as such. .. I would be interested if you are contacted by a Claim/Blame company in the next 2 weeks...

"Go to your union rep, tell them you think you may be entitled to make a personal injury claim. If they think you may well have a case they will refer the incident to the union law firm a body like Thompsons Law or whoever represents them. Their solicitors will do some investigating and if they feel you have a chance of wining will take action against your company for negligence. Good Luck" thank u . I'll be honest it's all new to me this , plus I do have learning difficults and really need some advice and support from Union . Plus i do feel if it happends to someone else at company and they end up a lot worse than me would I feel bad that I did nothing

One good thing they did was send me out with other driver for few days " If they can't demonstrate a bit of good will about time off for recovery or follow up, is not good... as you mentioned they fid put you on light duties for a few days. If you did make a claim, you would only like get a few hundred pounds in your pocket after the claim/Blame company has had their cut, happy to be corrected. Hope you are fine now and no lasting marks. Maybe you should now be asking for someone who wants to do a nurse fetish for you

"We're you trained to do the job correctly? I'm the H&S officer and you should be trained on how to complete a task before your asked to do it. The task should also be risk assessed. As for a claim you won't get a lot for a broken nose" a few thousand, its better than nothing seen as he broke his nose.

"I would also see your rep and ask why you had to take holidays rather than have a few days on the sick, most companies pay full pay when an accident had happened at work " not my place anothe guy was off after accident at work that wasn't his fault . They put him on statutory sick pay and wouldn't pay for new glasses for him . He had no choice but to claim

"Your employer Local small business or multi national logistics business ? If it's who I think it is, you will get tied in knots for a few years, they will then settle out of court for a nominal fee ... Meanwhile, I would start looking for exit strategies, because as much as they will re-assure you to the contrary, they will be researching yours ... and unlike their operational procedures, you can guarantee that your exit will be done by the book. As much as it needs doing sometimes, no business has time for employees that 'rock the boat.'" it is a big company . It's not the one who has his own fan club and tv show lol .
