Lad in work wants to go to America but was convicted of drink driving approx 7 years ago. He thinks he won't be able to go without a visa / interview.

I say he should be okay as it's not a crime of "moral turpitude" and I do know someone that has been with no issues.

Any lawyers / others in the know on this?

Speak to the embassy.

"Arrests and Convictions

We recommend that anyone who have ever been arrested and/or convicted of an offense apply for a visa. In cases where the arrest resulted in a conviction, the individual may be permanently ineligible to receive a visa and in order to travel, a waiver of the permanent ineligibility is required. The Rehabilitation of Offenders Act does not apply to United States visa law. Therefore, even travelers with a spent conviction are required to declare the arrest and/or conviction and apply for a visa.

Documents relating to your arrest and/or conviction

Applicants are required to furnish an ACRO Police Certificate issued within 6 months of the date of the visa interview. Information on obtaining the police certificate is available from ACPO Criminal Records Office (ACRO) website. This Police Certificate covers the whole of the United Kingdom of Great Britain and Northern Ireland and is sent to the address provided at the time of the application.

All applicants who have been arrested should also complete the personal data form VCU1, and should provide as much detail as possible concerning their arrests/cautions/convictions, including those in a third country.

Important Notice for Applicants applying at the U.S. Embassy in London. The original police certificate will be retained on file by the Embassy. Applicants who wish to have the original document returned to them on the day of the interview should also bring a photocopy of the document and a stamped, self-addressed envelope."

Hmmmm he's seen all this but the question on the ESTA doesn't ask about convictions other than "moral turpitude".

I'm not a lawyer though.

Personally I've told him to go through the embassy but it seems time consuming and very expensive!

Anyone had similar experience?

Don't listen to those saying just go you will be fine. He will have to apply for a visa. They are actually very fair in the visa processing. I'd rather not get caught and deported from the U.S. for something that I could of resolved with a visa.

I believe the visa is called ESTA, and mer too, i even had a green card to work there, just be honest thats all id say, and you CAN apply online

1) sweet stealing at school (caught and punished)

2) sweet stealing at the shop (never caught)

3) a bus journey and a couple of train journeys sans billet - before they had barriers (escaped the imaginary pursuit)

4) speeding (captured on cam and fined)

5) not telling check out people they have made an error in my favour (guilty by omission but not caught)

And if he ticks the box on the ESTA and says "No", how are the US Immigration Authorities going to know differently?

I doubt that the terrorists put on the form - "Purpose of visit - to blow something up and kill lots of innocent people", but they seem to get in to the country!

Do the UK really provide a list of all those drivers who have been convicted of drink-driving and provide it to US immigration so they can check it against a list of tourists who want to go on holiday to Florida for a fortnight?

I think they have bigger things to worry about!

I do not think that he is going to bother going to the US Embassy in London and go through all that red-tape just so he can go to Disneyland!

Oh I've just had a look at the ESTA form it only asks 2 questions about your criminal record so as long as you are not a drug baron or go around harming people or government officials you should be fine according to the ESTA form

he'll have no problem...i travel to the US every year..its an easy form,just need to make sure you fill it in in plenty of time..you have to have actually served a custodial sentence of 2 or 3 years,cant remember which,but other than that there's no problem

I'd never seen this form I went through the whole US thing in 2008 the ESTA was brought in 2010.,.
