Hotel fines someone for leaving bad feedback on TripAdvisor

Jump to newest

A hotel has debited someones card of £100 as a fine for leaving bad feedback on TripAdvisor. Apparently it was in the small print of their T&Cs

Madness

Do you get a rebate if you leave something positive?

If that's legal I'm opening a hotel.

I'll big it up in the description and then provide crap service to intentionally gain crap re_iews.

I'll be a millionaire this time next year!

I saw that! Doubt you get a rebate

A hundred quid was a bit steep but how did they identify who wrote the re_iew?

If the name of the hotel gets out it'll do more damage than any bad tripadvisor re_iew.

Apparently the lady didn't have her glasses so she couldn't read the print. Outrageous really but at £36 for a double room it wasn't going to be a top notch joint I guess.

I'm more than happy to receive negative feedback for free...heck ill even pay you for it.

It was the hotel who fined them.

I don't see how it's a fair part of terms and conditions, that's so harsh - and if it was £36 for a double room that's very cheap, they can't expect perfect re_iews!

Seen this on the news yesterday.

surely its theft?

Doesn't matter if its in the terms and conditions (although thats madness in its self having somthing in small print to say somome cant leave a bad re_iew on a userbased site like trip advisor).

Should be illegal for anyone with somones bank details to withdraw any amount of money from their bank accounts.

even parking fines or speeding fines you have options to not pay fine and take it to court if so be.

whats to say somome with a similar/same name to somome posts a negative re_iew or even the hotel them selfs could get somome to make a bogus profile under somomes name who stsyed at their hotel and create a false negative re_iew so they can fine somome 100 quid.

this is nonsense and needs to be eradicated and quickly.

if somone has a bad/unenjoyable experience at a hotel they have every right (without being fined) to share that experience with others.

I don't think it's fair from what I have read I don't know how factual that.is though.

These re_iew sites are a double edged sword for hotels etc. although they do have right of reply. I see lots of hotels and restaurants responding with comments that imply the person said it was all fine at the time.

Manchester Area

Checked TripAdvisor and read two or three pages and only found one slightly positive comment, all the others were terrible.

Whether you pay £36 or £360, you expect a certain level of cleanliness which seems to be sadly lacking in this place

I work in a restaurant, and I personally go through all of the re_iews we get. Some people leave negative re_iews about stupid things sometimes. I had a complaint before about serving a tea with no lid on the pot.

I don't even think trip advisor works very well. Every time you go to a restaurant, you'll get s vastly different experience every time.

As for the £100 fine, that's a little O.T.T.

I'd complain about no lid on a teapot but I'd do it at the time, I wouldn't wait until I got home and then log on to an internet site to do it. I swear some people are composing their re_iews as they eat

• Tony Jenkinson and wife Jan stayed at the Broadway Hotel in Blackpool

• Described it as a 'rotten stinking hovel' in negative re_iew on TripAdvisor

• But they later found out that their credit card had been billed an extra £100

• Couple discovered that the hotel’s policy was to charge for ‘bad’ re_iews

• Trading standards believe hotel may have breached trading practice rules

http://www.dailymail.co.uk/travel/travel_news/article-2840131/Couple-fined-100-hotel-called-hovel-re_iew-Punishment-TripAdvisor-comments-illegal.html#ixzz3JVoHpOD2

So the "fine" was not imposed by TripAdvisor but by the hotel and is being challenged.

After all the negative publicity I would have thought any fines collected would have been small change to the cost of the reputational damage caused. Superb own goal from hotel owners.

That isn't legal, it would fall foul of the Unfair terms in consumer contracts Act and Unfair Contract terms Act.

The hoteliers have done themselves a lot more harm than good.

Regardless of the legality of it, the naivety of the hotel owners is what matters - the bad press they are receiving will be 100s times worse than the one bad re_iew on trip advisor. (or more as other previous guests check their card balances…)

Greed and paranoia could have just been the death knell for the hotel in question - who would go there now?

As someone with legal qualifications I really doubt this is legal!

If they want do so something, they (the hotel that is) would have to sue in defamation albeit they would not get very far.

If the terms and conditions did say that then I suspect they would fall foul of the UCTA.

Shocking
