Somewhere in North Norfolk

Since some people are apparently unaware of this, prostitution is not illegal in this country.

Soliciting is illegal. Running a brother is illegal. Prostitution (meaning having sex for money) is not illegal.

Such an outdated set of laws. Surely it would be far safer if it was legal and properly regulated. Regular testing, a safe place for people to work from etc. Think of the tax revenue it would bring in....

There's plenty (I assume) who don't get tested as often as they should though. A legally run, we'll managed brothel would definitely help stop some of them slipping though the net.

Personally I'm all for it, even I never made use of their services.

Curious to how it can be tax exempt/ Care to explain?

As I see it, selling cigarettes to minors is illegal. but the shop keeper still has to pay tax, so how is this any different.

Reply privatelyReply in forumReply +quote

Just legalise it. Pay tax on it. Get licensed, requiring regular health checks to keep up your licensed status.

Let those who wish to do it, do it openly without fear, recrimination or condemnation - let those who wish to pay for their services do so freely and without fear.

Its just paying for a service - like getting Ovenu in to clean your oven.

Caution on the "its all legal" bit. If there is anyone else in the house it can be called a brothel even if the other person is a man or the escort's grandmother.

I think they should legalise brothels, they would be much better run, having to adhere to standards etc. regular health checks, pay tax and it would be far safer for the working girls.

At the moment a working girl is allowed to work with a receptionist, but if another girl is there with her its illegal

the problem with sex clubs/brothels is a 3rd party is making money off the prostitutes, rather the same as a pimp and that's illegal, if I picked a guy up in a pub, took him home and charged him for sex that's fine because that's my choice, if someone bought a guy to me, which in effect is what brothels are doing, and said you can shag her but I want my cut that's not legal because situations like that are open to abuse, how can you monitor which of the women want to be there and which don't

There would have to be a governing/regulatory body set up especially for it, rather like the CQC or OFSTED. It would be a complex task and obviously wouldn't be perfect but I Think it would be safer for everyone in the long run.

This is true but it would be a case of "get tested or don't work in a legal brothel" much like the commercial porn industry.

I would very much like to see Brothels legalised. The improvements to physical and sexual safety, benefits to the tax system, the localising of an activity that would lower house prices away from residential areas. And probably better money for the girls in more comfortable surroundings.

Everyone wins really.

there are some very clever arguments visible on .gov that explain why, and what criteria

ask your working friends to try and register themselves at companies house in their honest trade and see what response they get

You do not need to register with companies house to pay tax! Agreed you couldnt register as a LTD but you do seem to be confusing issues here.

Lets make it simple, you earn money, you pay tax on it. Tax exemption is a nice idea but doesnt exist

I have no idea, legally they are to be taxed, whether people break the law is hardly going to be discussed publicly is it.

Still doesn't change anything re tax exempt status though.

I never said you had to be a registered company to pay tax, the argument that is on the .gov is from a case in 2012 that was won by proving that due to not being able to trade with the same rights as all taxable companies then there are certain criterias that allow untaxed income that exceed personal allowance, its published by the gov

The prostitutes becomes self employed, but in order to undertake the profession legally, they must become a licensed sex worker. A condition of the licence (apart from being tax registered) are regular private clinic GUM checks ups with the results placed in the central licence registry. Failure to do GUM checks means your licence is revoked and your practicing without a licence (illegally).

Its sort of a DVLA for sex workers.

Its not a perfect system (and one which honestly took me 10 minutes to think up) but it would be starting point!

I will look that up in due course, but taken direct from UK revenue and customs site:

If the activities of a prostitute or any other person deriving income from prostitution are organised in such a way as to constitute a trade or profession, the profits are liable to income tax. This was confirmed by the ‘Miss Whiplash’ case, CIR v Aken [1990] 63TC395.

Now If you fancy arguing with them, your on your own

firstly, google section 62 itepa 2003. its clear on the gov site that tips given personally to the individual and not to the employer are personal gifts and un taxed, its there for all to see!

tips are only taxable if included in a price or paid to an employer

its on the revenues own website ffs, how can you not understand that personal gifts given to individuals are not taxed?? it doesn't matter to us if it is or it isn't but when its clear to see the legal route that can be used and does get used

door charge or massage, taxable

set prices.... taxable

any gifts or tips, regardless of what for, so long as paid or given to the individual regardless of profession are un taxable, doesn't matter if your a waiter, prostitute, postman, anything
