Can a restaurant legally take the staff tips off them?

Apparently its an incentive to improve.

Businesses can distribute tips however they like, as long as the patrons are told clearly how the tips are used.

No! Tips are not part of the pay package listed by the company as part if the renumeration package in the contract. If the company was not selected by the emploees to manage their tips I.e tax payments they are breaching the employee rights.

who is keeping records of how much tips are collected each day?

Do the employee have access to this information?

Can they prove they aren't using your tips to cover sales shortfalls?

Who elected them to be troncmaster to safe guard employees tips?

Thanks for advice.

Husband is a chef and tips are split 50 50 between front of house and kitchen. Last few Weeks a incentive program has been set up lol so i.e. if your fridge is untidy you loose ur tips. Now this Weeks the owner went for a meal and reckons his food wasn't up to standards.and has.removed all tips.

My question is were is this money going as Simons tips alone are on average £100 per Week..

I tip the person in question by hand, in cash. I want them to have it and nobody else. I just make sure its done discreetly.

Not at all! That's a hell of a lot of money to lose!! Would suggest you try to sort this before xmas comes - as if the (not very nice man!) gets away with it once without too much bother - i'm guessing he'll keep doing it - and in the xmas season the tipping stakes are potentially very high!

Good luck - but the staff need to ascertain their rights and stand together on this one. Xxxx

I'm now thinking of the argument in Reservoir Dogs, where Mr Pink is declaring that he doesn't tip.

I think tips should belong to the staff, not management.

Being a chef is a hard enough job without the management nicking his tips

Incentives? What a load of rubbish,use a bonus as an intentive,don't take away money,its backwards thinking

Fraid not. If the chef came out to the front of house I would. Nicks restaurant in Bolton is very good and he always comes out to check. But he charges a LOT and it is his place. So my tips go to his waitresses, and they're bloody gorgeous to.

Then where are the tips going. If I tipped and found out the staff was not reckeving them I wouldn't be happy.

Thanks never.thought about xmas last year one Weeks he got 400 tips stupid money. Xx

Yeah he works so hard spends 80 hours a Weeks nearly away from his family it is total bs xx
