What's all the fuss about? What did the lad do wrong? He heard a noise in the night, saw his girlfriend missing, went to investigate. Heard a noise in the bathroom, assumed this must be a burglar taking a shit so naturally tried to hack the door down with a hammer, then shot through it.

Isn't that all perfectly normal?

Personally, I think he should be considering himself exceedingly fortunate that he was not convicted of her murder, and therefore should accept of whatever sentence is handed down.

His choice to act as he did any reasonable person would know there are consequences to our actions.

He's such a bad lier & his story of the events are flawed big time.Nothing but a fake.His only remorse is that no one believed his story when expected otherwise.

I've always believed his story to be honest, and he has obviously been traumatized by the whole thing, but if the judge isnt careful when choosing his sentencing, there will be a huge uproar. I believe his version of events that he shot at her thinking she was an intruder because he had a heightened sense of vulnerability/paranoia due to his disability.

I read today that the gang that runs all of the prisons (the 26s) have put a price on his head - whether thats true or not who knows, but I dont think he would last 5 mins. We know that South Africa is an incredibly fragile and corrupt country and it's perfectly believable that whether in solitary and/or extra secure confinement, they will get to him easily enough. The prisons in South Africa are not run by wardens, but by the people incarcerated within the walls and he doesn't stand a chance in my view. Some people would say that what would happen to him in prison would be nothing less than he deserves though. Its a complex case and I do not envy Judge Masipa! Juicy

for me I don't believe that for a second too many holes in the story and parts that just don't make sense for me

and maybe it's me but i don't believe this so called gang wanna kill him for what reason because they care about a miscarriage of justice I think not

I don't he would get killed maybe given a hard time and extorted but a celebrity killed in a prison spells trouble for everybody especially the so called gangs that apparently runs this prison because if he got killed in there that would all stop because the world would then want justice for Oscar

He was clearly guilty of murder but the judge found him not guilty.

So don't be surprised if he walks away scott free as any thing but a prison sentence would be scott free.

There's a difference between justice and vengeance. Justice punishes taking into account the public good, victim and accused. Vengeance is a thirst for revenge.

The court dispenses justice and not vengeance. A life sentence for Pistorios or even death will not bring Reeva back to life.

So unless you're arguing for the man to be killed, then you really can't say 5 years isn't long enough because 100 years or even a life sentence will not be long enough either.

Consider for a minute what the man has gone through since the night of the shooting. His mental state has been affected, he's almost bankrupt, he will most likely never be a professional athlete again, he has lost friends and he will have to live with what he did for the rest of his life.

When you take these into account, then 5 years isn't insignificant.

And what about Reevas family? They have to live with a life sentence of a kind. They will never see their daughter again. Five years for taking a life? Not long enough. He'll be in his early thirties if he does the full five years, still time for him to rebuild his life.

I don't think it has anything to do with being happy. It's more about closure, and feeling that some justice has been served in what was a terrible tragedy for the family as well as for Pistorius.

His sentence is or life as well. He killed her, but it wasn't a premeditated murder so he has to live with the terrible guilt as well as serve a sentence. Nobody wins, nobody is happy. A heftier sentence won't bring back the dead girl.

Exactly. A level of justice has been served which is all that can happen when a person is killed by accident or otherwise. Pistorius life will forever be an unhappy one on some level due to this happening to him - he isn't a murderer as such but he did kill a person which is a hell of a thing to have to live with if you're not a psychopath.

Yes, but a harsher sentence won't bring her back - all they can hope for is a level of closure, and that's what this does. All this eye-for-an-eye stuff, or sending people to prison does nothing to make the pain of loss any different I can assure you. The Steenkamp's are sensible people, and they understand this, clearly.

I think this is the issue whenever people talk about this trial. The justice system in South Africa is different to over here so sentences that we expect to be served here may not be the tariffs that judges in South Africa have to work with.

If he genuinely believed there was an intruder in his house then I don't think he acted disproportionately. There were a number of questions though that made me wonder. I am surprised that he didn't just get house arrest. Justice in SA is very much loaded in the favour of black politicians, political hangers on, then celebs and finally ordinary folk like us. Had it been a politician he would have got community service. Someone like us would have been 20 years. I just hope he survives and doesn't come out with aids.

Reeva's family may be the primary victims but they're not the only victims. Oscar's family are victims as well because they didn't shoot anyone but will suffer from this as well. I've got sympathy for all these people and in some ways for Oscar as well.

There's a very good reason why victims of crime are not asked to judge and sentence the accused.

Hence a court does this, and more often than not, all the victims will not be satisfied.

What is most important therefore is giving closure to the victims and helping them move on. And this also includes Oscar.

never said he planned to kill her but I do think he snapped big time and when people snap all sense goes out the window for example remember that women who snapped during an argument with her boyfriend stabbed him and killed him in the car called the police said it was somebody else after road rage forget her name but my point is people snap and try and cover it up afterwards when they are thinking straight again

I'm late to this thread so bear with me. . Has anyone mentioned what SA prison is like ? I don't know . . But i have heard they are a polarised version of modern south africa. . Harsh . . Corrupt . . Violent to the extreme. In a nutshell i see it like this . . Bloke acts a twat with a gun. . Shoots the love of his life dead. Shatters two families' lives . And his own. I'd guess a man who has had his life hasn't had it easy and learned to act the victim or lie through his teeth. Both families accept the sentence. He'll most likely be brutalised in jail. A lot. Because he's famous and is an easy target. Fair point or have a missed something ?

5 year maximum sentence, but with the possibility of only spending as little as 10 months in jail and the rest on house arrest. Open to appeal from either side, Oscars team probably will not appeal, but the prosecution side might.

No Judge should have that amount of power, the case has been a farce from day she got murdered.

I think they are a bit scared having to look after him in jail and keeping him safe and maybe if out its not them who will get the blame if he is hurt in some way ... as there some who will be looking to get to him for the fame and the money in jail as they know he has both.

Was just watching sky news and they interviewed a South African journalist who has been looking into the court and prison system.

It was her opinion that there was no doubt that Oscar would get the VIP prison treatment.

She was also commenting on the defence team smiling after the verdict as they left court.

This would make you think their happy with the sentence so doubt they'll be appealing.

Was interesting to hear what she had to say.

You obviously are not aware of the horrific overcrowding, AIDS and sexual violence prevalent in South African prisons. Group cells with up to 20 people in them, corrupt prison officers often turning a blind eye to assaults make rape an all took common occurrence in SA prisons. Even being in a holding cell overnight has had horrific consequences for a large number of men in SA. SA prisons are nothing like Porridge.

I am aware of the state of the prison system in South Africa - I'm also aware that money talks and that it has already been quoted by prison inmates in SA (and by me already on this thread) that Pistorius will be well looked after in prison by those inmates, and the gangs inside who are all ready to help him do his time unharmed in return for money, of which he still has more than the majority of them do.

You may well be right about certain aspects of prison life in SA, but I really don't think the same rules apply to certain people. Thanks for qualifying a little further on your earlier post by the way - initially it seemed like a very knee-jerk, throwaway comment so thanks for backing it up a bit more.

Not direct personal experience but I've known quite a few people on both sides of the bars in SA prisons.

It always upsets meet when the terms 'closure' and 'moving on' are used so glibly.

When you lose a child there is no closure, no moving on. You slowly develop coping mechanisms that allow you some respite, mechanisms that supress, mask, and make life bearable and worth living. Five, Ten years may pass, but the pain stays as strong as ever. For the rest of their lives not a day will go by without them thinking about her, and how they miss her.

he got off according to the laws and sentencing of his country.

I have to say I watched most of the trial, read most of the SKYNEWS TV coverage and their tweets and came to this conclusion.

The prosecution had to concede to large parts of the defense evidence.

NEL, completely and utterly tried to use the prosecutions evidence to suit his version of events, he was completely misguided by the evidence collected and how it was secured by at best a dubious police service.(remember the original investigating officer was also under investigation)

""Hilton Botha, the detective leading the investigation, had crumbled under defence cross-examination on Wednesday after he wrongly claimed to have found boxes of "testosterone" in Pistorius's bedroom and admitted that police had no evidence contradicting the athlete's version of events.

On Thursday further pressure was piled on South African police as they admitted Botha is himself charged with attempted murder"".

Witnesses were shown to have no idea what Pistorius sounded like so the evidence over a women screaming was at best inaccurate plus Reeva couldn't have screamed due to the nature of her injuries. their recollection of time lines of events were grossly inconsistent as at the times claimed security was patrolling outside and around Pistorius's home and no screams or disturbances occurred.

and those that matched the defense versions were ignored.

Evidence was tampered with and not stored correctly or securely, eg The toilet door was left in a hall way for weeks uncovered. Personal possessions went missing such as one of Oscars watches.The scene was tampered with or changed.

That included Reevas jeans which in one pic were the wrong way out and in another the right way. Electrical items were unplugged and moved. the hall and bathroom light were both not working so it would be impossible to see into the pitch black room.

The defense forensic witness had far many years experience and had been in charge of the countries forensics, he was grossly more qualified than the prosecution witness, to the point of being able to recognise the patterns and structure of stone and wood.

He discovered injuries to Reeva that the states pathology had missed.

gun shots that were heard were conceded by the prosecution to be that of the cricket bat hitting the door.

Reeva had left her Valentine gift and card at the scene. this wasn't looked at by the prosecution.

A witness that had claimed to always sleep with their curtains open was found on many separate occasions to draw them.

During Oscars young life while living with his mother the family would sleep in her room and she would sleep with and keep a pistol under her pillow as they'd experienced many break ins.

It was also demonstrated the He was on his stumps at the time of firing due to the angle of the shots, the shots didn't form a concise pattern as if firing at a range and remember firing such a powerful handgun when on stumps would have affected his balance.

You see there were foot prints on the door which were discovered to come from the detectives and those at the scene who repeatedly walked over the door as it lay on the bathroom floor crushing the various fibre strands and corrupting the evidence and as I said earlier the door was then stored in a hallway, just left laying up against a wall.

Nel, failed to secure a conviction of premeditated murder simply because and despite his best attempts to show Pistorius as an evil disabled man that the evidence just didn't stack up, it couldn't and never would show premeditation.

Again the prosecution had to concede many points including the timelines of more shots than were actually fired.

And don't forget that in the last week or so it was revealed that the Steenkamps have been receiving monies from Oscar sine her death and kept it Quiet?

Before the shooting, Pistorius was involved with a university in Glasgow to develop prosthetics that were more durable, cost effective and comfortable."

As much as you dislike or have jumped on the dislike bandwagon Pistorius didn't kill Reeva with premeditation.

they then have case law of indiv's not serving a prison sentence where there has been a killing in the home.

They also in South Africa

have a philosophy/system called Ubuntu which relates to redemption,

Which ever way you look at this case it's the most tragic of circumstances for all concerned. No one with his life, fears and up bringing could properly understand what went through his mind that night.

remember, Nel had all the tools available to secure a conviction for premeditated murder and he couldn't. The evidence wasn't just flawed it wasn't possible.

The Steenkamps have said they are happy with the conviction, Pistorius family have said he will embrace the decision.

Pistorius family are aggrieved in the way in which Nel played the case and his attempts to keep up the premeditation angle despite agreeing with the defense points from time to time.

As I watched the trial unfold both online AND Live on SKY NEWS and via Twitter( IT WAS ALWAYS DIFFERENT TO THE ACTUAL WORDS SPOKEN IN COURT) who seemed desperate to get a premed verdict were ultimately disappointed it was understandable Why the Pistorius family are holding this view.

During the case SKY had on there team a SA lawyer who loved the TV camera, his opinions whilst the trial was in progress were listened to like Moses handing down the commandments earned him a judgeship, but later had to back track on some of his opinions as the evidence unfolded in OP favor.

Of course You have to feel for the Steenkamps, they have lost a beautiful daughter and now they are going to struggle going forward.

They have been let down by Nel who's possibly promised far more than he could deliver!

Oh and I'm not a fan of or dislike Pistorius, I was intrigued by the SA justice system and as I had the time of the trial free I watched out of some morbid curiosity you know like you would and it just so happened that I found a new job just as he was being subject to the mental health checks. then some 6 weeks into my new role whilst traveling home I was hit head on at a combined speed of some 120mph and I was trapped in my car for some 3 hours, turned out she'd overtaken cars in front of her coming towards me and to do so crossed double white lines! I've been having flash backs of the incident thats put me here in the chair. and trust me when I say there's a considerable amount of fear as well! I'll say no more on that.

"If he genuinely believed there was an intruder in his house then I don't think he acted disproportionately. There were a number of questions though that made me wonder. I am surprised that he didn't just get house arrest. Justice in SA is very much loaded in the favour of black politicians, political hangers on, then celebs and finally ordinary folk like us. Had it been a politician he would have got community service. Someone like us would have been 20 years. I just hope he survives and doesn't come out with aids.

Your post was going well until your bizarre ending about AIDS.

There have been reports of prisoners in the prison he's going to, making ready for him. He'll be very well looked after by all accounts, so your comment makes little sense and is inflammatory at best.

You obviously are not aware of the horrific overcrowding, AIDS and sexual violence prevalent in South African prisons. Group cells with up to 20 people in them, corrupt prison officers often turning a blind eye to assaults make rape an all took common occurrence in SA prisons. Even being in a holding cell overnight has had horrific consequences for a large number of men in SA. SA prisons are nothing like Porridge.

I understand that the Governor of the jail is somewhat angry at these comments about OP being looked after inside as it's the paid job of the guards to do that and it seems heads will roll! not literally I sure!

good response, not trying to be flippant but watched the Mary Berry interview with Piers Morgan earlier and I'd no idea she'd lost one of her sons when he was just 19 and studying at Bristol, he'd taken his sister to pick up a newspaper one afternoon and had a car accident and died, his sister survived without a mark. even now after all the time that has passed she was tearful! it was very moving, her sentiments were exactly as you said.
