"A British man and American woman got married in Australia in 2011 and moved to the UK to live. They did not complete immigration forms before they moved over here. They now have 2 children with another on the way (she is 6 months pregnant). They have been refused NHS treatment for her pregnancy due to her non- UK citizen status. She is now facing deportation back to Australia. What do you think of this story...?" How did she get NHS treatment for the other two? I don't know what to think and I hope this doesn't follow the path I think it might. | |||

Their relationship seems genuine enough if they have children together, Sure they will sort this out. And why are they considering deporting her to Australia if she is American? Odd. | |||

As someone who has gone through the system, it's an absolute minefield. Immigration also makes mistakes, which may have happened in this instance. I'd need to know a lot more to really know how to respond to this, but i hope she gets it sorted very soon. | |||

Yes! I was reading the latest release from the ONS on the 2011 Census looking at the London figures. India, USA and Australia were the largest contributors to international migration in London. Twenty odd years ago I employed I employed an Australian woman. She went on holiday and I got a call from Immigration to tell me she had overstayed and re-entered the country illegally. When I asked her about it she just said that all of her friends did it and it's not like they don't work and contribute so why should anyone mind. | |||

"If she's married to a British man, I can't understand why there's an issue. I've not seen the story." You still have to apply for spousal visa and then for spousal citizenship. This happens a lot more than people realise but the press rarely report the stories when it's a black/ethnic British person with a black/ethnic person from another country in this position. | |||

"Although I don't know the whole story, nothing surprises me anymore about how members of the British Commonwealth are treated in Britain compared with EU citizens. I'm an Australian born to a British mother with the right to abode (not allowed to have duel nationality due to certain criteria...), married to a British man and have lived here for over 20 years, without any support from the taxpayer and have worked for 20 years. Every time I re-enter Britain, I'm treated like an illegal alien with the immigration officers being rude to me. It does make me mad sometimes and has become worse over the years. Australians are allowed to enter Britain for 6 months without a visa and to have medical treatment, as there is a reciprocal agreement between Australia and Britain. They are not allowed to work without a visa nor overstay the 6 months. Yes, rules are rules, but Australia was founded by Britain and should be treated like part of Britain and not left out in the cold; whereas other countries whom have no historical ties, are allow to pass British borders unheeded, allowed to claim benefits and bringing their own trouble with them." I'm from a Commonwealth country too but it wouldn't mean anything in terms of how I would be viewed if I wasn't naturalised. If nothing else the Commonwealth Games show just how many people of colour would then be eligible under your thinking. It may be them that the rules are there for of course. | |||

How could they not know?" My brother (British) married an Australian. She completed the paperwork lived here 10 years. They've just emigrated to Australia with their child. My bro says it was a nightmare, getting into Oz c.f his wife getting residency here. And shouldn't immigration policy be implemented equitably, not on the basis of a popular sympathy vote, or by the colour of your skin? | |||
