Topless sunbathing is getting my neighbourghs all worked up

But which one?

At 10am today I went outside topless to make the most of the hot sun! Half an hour later...door bell rings so I put something decent on (as you do).

The police was at the door!!!! Telling me that my indecent exposure was making my neighbourghs uncomfortable. So I asked the 2 officers to tell me which of my neighbours had reported the felony...when they refused to tell me I invited them to come rounf into the garden so they could see that unless someone was on purpose looking into my gardenmust explain that on my righ there was no way I was exposing myself or being indecent!

On my right are 2 very old ladies - average age 80 and on my left a 40 something couple with a milf that's does not work on fridays!

I thanked them for highlighting the problem but explained that I was on my own property and could and will do as I please. Surely neither neighbours have to perve into my garden and they should mind their own business! Luckily I don't care much for neighbourly relationship!!

Was I in my right to sunbathe topless? Should I be a bitch and report them for perving?

I have no idea how people can be offended by someone being nude on their own property, especially if the only way they could see you was to purposefully look into your garden. Keep doing it just to piss them off would be my childish response.

As far as I know you have every right unless where you are is on view to a public space/street etc. you could then be done under a rather ancient law for "outraging public decency".

As you seem to be on private property and can only be seen from someone deliberately looking from private property then seems to be so doll that plod can do....Carry on Sunbathing.....and if they ever make that a film I want royalties!

Why are your neighbours looking into your back garden anyway, the cheeky sods, you shouldn't have to cover up just cos it offends them when you're in the privacy of your own property...... I'd go fully nude just to annoy them

It's not an issue for me but let's play devils advocate here and assume it did offend you members of Fab.....why not simply tap on the door and say "look this is a bit awkward but do you mind being clothed, it causes us offence because....". What a waste of time for the police. You must be really scary bambi for them to be called lol.

We go fully nude but neighbours would have to make an effort to see us...no complaints yet...whether that's because they've not looked or if they have we don't know....I think the law says that you have to cause offence so the act of just being naked or topless is not an offence in its own right...but you might want to check this.

I'm actually surprised the police came that quickly for such a trivial matter. Obviously not got much to do !

I'm lucky at work - I quite often get to ogle police officers. Some of which are rather dishy.

Simply being naked in a public place is not an offence in English law.

If you are simply enjoying social and recreational nudity - swimming, sunbathing or walking, on a beach or other open space (including your own garden) and doing so with reasonable consideration for others, you have every reason to defend your right to continue should you be challenged by a police officer or a representative of the landowner or local authority.

In law, there is no difference between "official" and "unofficial" beaches or any other part of the countryside.

However, if public nudity is intended to cause "harassment", "alarm" or "distress", to "insult", or is associated with sexual activity an offence may be being committed.

How your behaviour is interpreted is likely to depend not only what you are doing, but also on the circumstances in which you are doing it. Let's put it this way:

· If you are in the habit of sunbathing without clothes on a quiet stretch of beach, perhaps one with a long history of such activity, then you are very unlikely to find yourself in trouble.

· If you attempt to walk naked down your local high street you will, within a few minutes, be coming into contact with the police.

In the real world, however, you would be well advised to take some simple precautions, including explaining to you neighbours that:

You want to sunbathe without clothes but,

You have no wish to offend or upset them

You will be discreet

You hope they have no objection.

Confining you naturism to a part of the garden which can be screened from the view will obviously solve the problem. If none of the above is possible, you will have to decide whether your desire to be naked in your garden is more important to you than being on friendly terms with those around you.

While the police may well be reluctant to become involved in a dispute between neighbours they are bound to investigate an allegation of "indecent exposure" or "outraging public decency".

If the worst happens and the Police were called, you would be advised to make it clear that all reasonable steps had been taken to prevent someone from seeing and that there was no intention to insult or to cause anyone alarm or distress.

On the other hand, no-one has the right to spy on you and if you find that your neighbour is leaning out of an upstairs window or standing on the top of a step ladder in order to see you then he or she may well be committing an offence.

Public nudity isn't an offence, you can only be arrested if someone complains about your nudity. Even then you can only be proscecuted if the police can prove you were deliberately causing an offence by being naked which, if you were simply sunbathing would be very difficult to do.

L sunbaths naked but has a spot where she can only be seen if the neighbours stand at the right angle at their bedroom window. They have both seen her from time to time, they don't object, little joke about it sometimes but never a complaint. But should they ever move things could change.

Exposure of genitals to another is an offence if you do so with the intent of someone seeing them and it causing them alarm or distress, be it in public or private. Topless sunbathing in a private place (and out of the sight of anyone in a public place) therefore is not an offence. There are a couple of offences that you could be charged with if you get your baps out in public, easiest one is the public order act.

I agree with everyone who said...'The police have better things to do', unfortunately they do have to answer those calls. I do not feel bad about my half nudity as I was not indecently exposing myself but I feel bad for those 2 lovely cops who never got to see what they other(s) saw...its a really hard job they do xx

If you were in full view of everyone walking past, say on your front door step or something then I don't think that's appropriate.

But in your back garden with a high fence, that may only be overlooked by other houses from bedroom windows then that's not a problem. Someone would have to stand in their bedroom window to see you- they just shouldn't stand there!

Having sex in your home but that being viewable from outside is also the same offence. You are in your home but others can see you.

I am taking it on board and although I do not feel that my behaviour warranted a call out from the police..(I wish it had been themuffinman though ) I shall have a talk with my neighbours. I don't want to upset them but also want to be able to sunbathe topless without hassle. I'm sure we will come to an agreement.

As far as I know if you are in a private place where you are not directly overlooked from either a public space or an adjoining property and any person watches you without your prior permission then they commit the offence of voyeurism (an offence that gets you on the sex offenders register)...

If you are not directly overlooked keep doing what you are doing and do more! Next time the police arrive at your door report the crime that is being committed by your neighbour. I guarantee they will not be making any more complaints about you after that!

If you are out in public its not an offence being naked unless it upsets someone...there is always one lol! being naked on your own property (if its concealed) rarely gets you in trouble so ignore them and sunbath.
