the rules of self employment

Ok, I am very worried, can anyone advise?

I am registered as a full time student but I do work at the Uni on a casual hours basis, helping out with the odd research project or teaching. This is my only source of income & last year I earned around £8000, this year so far I have earned less than £150. I'm into my savings to pay the mortgage.

Today I found out the Uni cannot pay me for any research as I am not self employed. I phoned HRMC about this & they said I would be fined for not registering at the end of 2012 - when I started casual hours. I can't afford a fine!!

So, what do I do?? Serious answers only on this one please.

Did you declare all of your earnings to HMRC? Complete a self-assessment form? Have you been paying NI contributions?

If there is a record of you doing all of that you might be able to argue that they knew you were self employed. Or not. It's HMRC.

I think you are going to need to speak to them again.

See if you can get advice from a friendly accountant.

When you phoned HMRC, did you give them your name etc?

No I didn't give any personal details like that, just a rough estimate of my earnings for last year. According to one very helpful person on here who actually deals with this kinda stuff, I might be ok. He PM'd me & he's a legend!

It depends when your tax year runs from. If it's not the standard April 5th ish to April 4th ish ( can't remember the exact date), you might be ok as it would fall to be submitted in the coming tax year. As an example, I've just submitted my 2011-2012 accounts for the 2013 returns. Yes, ok was at 11.59pm on the 31st January but still on time.

first mistake was contacting the HMRC !

but at least if you never gave any personal info name NI number then its not too late

just download the relevant info from their website and register as self employed you don't need to pay tax on the 1st 9k or so but you do have to pay class 2 (stamp) approx £15 per month once you have done a year you need to submit your return but don't forget you can claim mileage clothes office etc and any other reasonable expense

How can you be self employed if you are researching/teaching for the Uni? Surely they would have to have you on their organisational books and be paying contributions appropriately?

and you could probably register for exemption from NI contributions on account of low earnings. If you wanted to.

Surely if you're a full time student, and you earned less than the annual personal allowance (about £10k) then you don't have to register anything??

Apparently it's an insurance thing. They can cover me for the teaching I do & other stuff for the Uni. It's when I do research which is counted as consultancy, I'm not under their insurance. Even though all I do is actually on the university grounds. Anyway, I apparently have to register self employed & make the tax man aware of my pultry earnings. Good point on what the Uni counts as a tax year, I'll need to find out.

Anyone know how much personal liability insurance costs? I genuinely can't afford it, but I need it.

public liability varies in cost quite a bit. There are plenty of internet based companies to do a search on.

All you need to know is how much cover you are expected to have and hopefully they have a box to tick that sounds like what you do.

I found public liability insurance really cheap, I'm a self employed gardener. The insurance was around £160 for the year and covered me for over a million.

It was an internet search, maybe compare the market have them on there ?

Your professional body or the university department might guide you about tailored insurance.

I might be wrong but I'm pretty sure a tax year is a personal thing- it starts the day YOU started work

If you earn money one way or another you have to pay tax even if you get tips if you was working in a pub or something your ment to declare it so i have heard

If you need help with the ins and out pm us will give you my number and i will tell you what you need to do but you will find for not haveing your tax sorted by 31jan you may get a fine if you got less than 9400 for the year there is no tax unless you have income from other work you need a utr number from HMRC to reg self employed

Good advice. As per the tax year, since you are not a LTD liability company, the tax year runs from 6th April - 5th APril

every year. But if you have not earned enough to absorb the your single person personal allowance of

2011-12 2012-13 2013-14

Personal allowance for those aged under 65A £7,475 £8,105 £9,205

Basic rate limit £35,000 £34,370 £32,245

You do have to register but you won't have to pay tax on anything below the taxable limit. About 10k I think

I've never been self employed here, but after what I've understood from the years that I've been back here is; 'When In Rome'!!

Tax avoidance has to be universal to get 'everyone' to tow the 'nation' line!!!

Thank you everyone for the advice & comments.

I could afford the mortgage because I was on a research studentship (not taxed) for 3 years & since then have done work for the uni. I asked them about it 2day & they said not to worry. I've been getting payslips from them all this time, with NI contributions taken off. But I didn't earn enough in the year to pay tax. They are going to try to sort out some kind of contrast for me from now on so that I am a full employee, albeit on a low paid contract.

The finance director is looking into it too.
