Fijian soldier who moved to the UK after serving in the British Army for nine years faces deportation on Sunday after spending a month in a immigration dentention centre because of a simple administrative blunder.

Private Filimone Lacanivalu, who served in Northern Ireland, Bosnia, the Falklands and Afghanistan, left the 2nd Battalion the Yorkshire Regiment in 2010.

Mistakenly believing Commonwealth troops automatically qualified to remain in Britain after more than four years in the military, he failed to apply to the Home Office for residency within 28 days of leaving the Army and missed the paperwork’s deadline,

Sums up the care,thought and consideration given to those in HMF,by all Governments!!!

It is a disgraceful way to treat someone who has served this country well but the MOD has a long history of this sort of behaviour, witness the ghurkas and those who were born overseas but whose parents were serving abroad for this country?

My mind boggles!!! It's a disgrace in my opinion yet we let non British nationals such as those who murdered lee rigby in cold blood live it up in prison. This country is laughable at times.

Surely he should have double checked residency when leaving the forces.? Or at least asked a few questions.?

Maybe the soldier and MOD could've done more.

i think there are a few over the top reactions surrounding this ...the bottom line being that the guy failed to submit a right to remain application therefore there was no paperwork for anyone to process ...that said i sympathise with his situation enormously

His case is under review and a wrong can and hopefully will be put right

From what I have read however the border agency have been doing their job over zealously as maybe but we have laws an rules on immigration

They are poorly applied at the best of times

Hopefully as I said the decision will be reversed

I do think in the mean time he should be released

They are both british nationals so out of interest, where do you feel a british national who commits a crime in Britain should serve their sentence? And how do you know they are living it up?

Back on topic, yes based on those facts a total disgrace. But I suspect discretion is difficult to apply in an area such as immigration. But there are several parties at fault here and that includes the individual and the military not just immigration officials.

It's amazing; government discovers someone who can be deported at will, and without violating his human rights.

Just wait until our European friends from Bulgaria and Romania arrive from the end of January; my American friend stated, in January, that it was impossible to get hold of new Mercedes Benz coaches as they were all being sold to customers in Bulgaria and Romania.

Just shows how our government can waste our money...the guy obviously qulifies for residency all hes done is submit his application late... is it too difficult for the immigration department to obtain confirmation from the guys regiment and just rubber stamp his application ...a simple email would suffice..but no the poor guy has to go throughan official investigation whilst held in a deportation centre....if he was Poland or any other eastern block country which has joined europe hed be given a house and money to send home to all his reatives and ofspring!!

I've not actually read the story yet so cannot comment, but sounds like a similar case of those Ghurkas who applied to be British citizens..... If they serve for the British Armed forces, then the transition to become a British civilian should be made a whole lot easier!

I think with the Gurkhas they knew when they joined their money pensions were less and they were not entitled to stay in Britain after their service

At the end of the day as many have said the MOD and himself could have done more but to be detained for 4 weeks is the part I have a hard time with.I travelled the world for approx 20 years and had many dealings with immigration some good some bad and some pretty crap. I had been detained a number of times in detention centres and police cells and pretty well most of the time the case officers dealing with me and others attitude was just rust rubber stamp and release without all the bureaucratic crap involved .My last experience I was fast tracked with the good old rubber stamp instead of going through weeks and weeks maybe months of bureaucracy.I personally know it can be done!!!

Remember the Border Agency and the coalition govt aren't best friends at the moment.

Sticking rigidly to rules which make HMG look bad suits them fine.

I believe he is in the country this week but no rapping is no reason for an exclusion order . Tho some may disagree
