"Hope she won't need to ask for a reference from them! " Most companies don't write proper references these days, just statements of work so if the rest of her attendance etc was ok it won't reflect this. | |||

Any reference you send to a prospective employer on a ex employee is subject to dis closer under the human rights act. You owe a duty of care to the ex-employee in providing a reference to a prospective employer. Your duty is to take reasonable care in the preparation of the reference and you will be liable to the employee in negligence if you fail to do so and the employee suffers loss or damage as a result. You are quite right in saying that you can say the truth in a reference but this is often dangerous ground as a statement must be provable in a court of law, and we all know how difficult that can be. It is an unusual practice to give a bad reference. In plain English, it is just not good policy. If an employee has under performed or has not come up to expectactions, any reference should simply say enough about the employee to alert any future employer without being rude about the employee. In other words, saying nothing about a given aspect of an employees performance, is the same as switching on a fire alarm. Any prospective employer will pick up on what is not said rather than what is said in a reference | |||

I once told my manager that whilst he's a great guy, he had no people skills and couldn't manage a piss up in a brewery, I had far more experience than him as a manager and was trying to help in on the QT, 1 week later he had me fired Hopefully he as become a better manager, but theres no chance i'll change, to northern I think " This is me, again I use the Northern excuse too!!! I told my manager he couldn't manage a piss up in a pub, he is the general manager of the pub/restaurant I currently work in. My new assistant manager is even worse. Glad I'm leaving in 17 days!! | |||

It would be more credible if you'd not stated that providing a negative reference was illegal. If an employee doesn't turn up for work and you state so in a reference I'd say you're on pretty safe ground. That being an indisputable fact etc. I haven't been taken to court yet. In all cases I've informed the people that they wouldn't be getting a great reference - and pointed out that had they informed me in advance I'd have advised them not to use me in the first place. Surprising how short some peoples memories are though. | |||

" it gets me into too much trouble. when my brther and his ex split up (i was a friend to her and she told me things she probably shouldnt have) and he was going through the mill, blaming himself and so on, i just couldnt help telling him that she was sleeping with all and sundry while he was at work. yes, i probably should have kept quiet and just helped him with his demons, but he said it was all his fault for the breakup, so i didnt think it was fair. always tell people what i feel, and they do the same to me, so its a much better relationship i have with people than a hidden one where we all talk behind each others backs. | |||

That being an indisputable fact etc." Not wishing to get into an argument about this but its not indisputable, if the ex employee claims he was ill or says he received a telephone call asking him not to come into work and then claimed he was fired for bad time keeping there is an element of doubt I'm sure like 95% of us your a decent and honest kind of guy, a chair is a chair, and a spade is a spade, sadly all to often this is our down fall, so I guess that answers the question "how honest are you" is Sadly to honest | |||
