Tribunal advice

Anyone got any tips or advice they can offer when taking an employer to tribunal?

I have a hearing for the 1st October! I am currently putting together a list of documents as evidence.

I am taking my ex employer for unfair/constructive dismissal.

I am representing myself. I did consult an employment solicitor through my redundancy but feel he let me down somewhat in coming to a settlement afterwards and have now had to go down the tribunal route.

You hear it loads CAB are really useful

Have you been in touch with ACAS? Look on their website... That's what they are there for... Ring the advice line in morning...

Thanks, I already have an ACAS conciliator assigned to me, in fact I need to chase her up to find out if my employer has responded! However they are a mediation service not really an advice service as such x

as others have said ACAS website is good, CAB can (in my opinion) be varied in their service but generally good.

I have some knowledge depending on what the dismissal was over but mu procedures knowledge is quite good if you want to PM me x

you are entitled to 30mins free advice... Yellow pages... Employment lawyer...

Always be prepared to stick by your guns, be prepared for them to play dirty and be realistic with a figure.

Make sure you have all your notes with you, and if you get a bit overwhelmed or feel intimidated, ask for a break and catch your breath.

While at uni my son represented someone through a scheme run by the uni helped get her 9k if you have a local uni with a law dept try them He was studying law btw

Don't waste your time or effort, no money will compensate for the health problems bought on by stress, be bigger, they obviously don't want you, take the hint, let go and move on, life is much too short and time is the most precious gift you have.

Oh and on a logical note, you will make yourself unemployable if it , comes out at inter_iews, so you lose not gain, I know its wrong, but its the way of the world,

Hopefully you have a business idea, because that will be your future, in fact it is now, so go for it, in 12 months time you will look back and realise why things happened and be happy they did, because it releases you.

I hear what you are saying, however I am now self employed, I have watched this man single out and victimise all the good people in his company and I watched them all leave. It is not about the money, its called standing up and showing him he can't treat people the way he does!

I have no intention of ever being employed by someone else again. And I do also have a business idea and am already acting on it.

The man was threatened by me, as he had lost respect from all his staff, they came to me with their issues instead of him! He came up with bogus reasons as to make me redundant, all of which I proved wrong and will at tribunal. But as usual he did not listen to good advice.

Ah, its not about the money, at leastthats sensible, the other reasons are a complete waste of time, he is a loser and will eventually reap what he sows, learn from the past, but please remember you cant fix a broken cup, it will never hold hot water again, why cause yourself work, stress and hassle, he will never change, and your not the caped crusader, I realise you are a little stubborn, a bit like a dog with a bone, that's great, but use all your energy to move on, make money, and build a business where you can help others,

I understand the sense of injustice, but as you say its happened before and will happen again

.One thing I have learnt after helping and reading people for 35 years is

Life, it goes on.

no body makes themselves unemployable by standing up for themselves! It shows the little people won't be walked over. It took me three years, no stress at all. My solicitor and union dealt with it all and I walked away with 15k. It's not about the money, it's about making a stand! My current employer at inter_iew asked me, I was very honest with them, they gave me nothing but total support.

Well thank you for your opinion, but as you have pointed out I am a little stubborn. Your _iew that my other reasons are a waste of time, is your _iew and not mine. I am not trying to fix him.

As you are now self employed...are you a member of the Federation of Small Businesses? They have free legal advice for all their members. It is worth trying them for help. Message me for more information abot the FSB, and good luck.

It took me three years, no stress at all. My solicitor and union dealt with it all and I walked away with 15k. It's not about the money, it's about making a stand! My current employer at inter_iew asked me, I was very honest with them, they gave me nothing but total support.

I wish you all the best in this, I work for a company that walks all over its employes at the moment one of my friends is being persecuted by the owner/director of the company simply because he is gay, even to the point that he told him not to use the same toilet as him, I over herd my manager barging that he got rid of one of my team but it was regrettable that he had to get rid of the other one but he was just collateral damage while laughing, I also know that there is a plan to get rid of me, however I am waiting for that day to come cos I have a file half an inch thick of dodgy dealings, memos, and a diary of all the shit they have pulled, I also have on a memory stick a weekly updated list of customers, and drawings of every product that we produce, if I should get the sack I will not hesitate to bring the whole crooked temple down around their ears it's going to be biblical (Gerard butler quote lol ) I look thick and I act the clown, but I've been screwed over so many times I have to have that insurance

Just make sure you have everything clear. Stick to the facts and make sure you have all of your notes/statements and evidence with you from your disciplinary meetings and appeals with you.

as lady said the other staff who had a grievance did the right thing and left, that is always the right thing to do, if u don't like it, move on, a couple of sayings spring to mind, no use crying over spilt milk, your flogging a dead horse,

Legal actions can be a minefield. It's like trying to do anything specialised without prior knowledge.

Would thoroughly advise you get what help you can. Therefore:

- Check your home Insurance the legal add on's

- Check any business groups you are a member of for the same thing

-Try the CAB

-Try a legal advice centre through Unis etc

- google pro bono lawyers

Just a little update! I heard from ACAS today! It seems my ex employer has been in touch with them and asked if I will put forward a settlement figure! As he is using a solicitor to deal with it! I would imagine now they have seen all my evidence I want to use at tribunal, that they have advised him to settle! Fingers crossed! x

OP asked for constructive advice and help not to be belittled and told its s waste of time. She's doing a good thing for others as well as herself by standing up for what's right. Regardless of her next career move a tribunal doesn't need be disclosed at inter_iew and doesn't reelect of If right for job applied for

Woohoo shows he knows he's unlikely to win. Check if u have legal cover on ur home insurance as not only would it give free advice pay solicitors also covers loss of earnings on top of settlement I know u said money's not the point but hey we all need bit extra £!

Congratulations.

A similar thing happened to me a few years back, got a good employment solicitor and paid with house insurance legal cover.

sued the arse off them for wrongful dismissal, they tried to out bank me, thinking i would run out of money, got very rude awakening and were forced to settle on my terms out of court and included a binding non disclosure of termination, so they have to say was made redundant.
