Smoking in work vehicles

They are saying they will fine people who do this. £2500 for the employer and £200 for the employee if caught.

Since last year i now run my own vehicle but prior to that company cars for years before. Had the odd cigarette during that time to be honest. Not something I do now though.

But playing devils advocate, company car owners pay a lot of money in tax.

So is this right or wrong?

I think if its your van/car and you are the only person using it then you should be allowed to do what you want.

My ex used to work for a sign fitting company and often was stuck between 2 people puffing away on the way to work! Pretty unfair for those who don't smoke.

at the moment if it's youre own private van/car there is nothing they can do about it but company vehicles are classed as shared so they could push that through.

Personally I hope they bring in heavy fines for people who are caught smoking in a car with children in as I see it all of the time, typically mum n dad in the front puffing away oblivious to the fact that they are choking their children in the back.

Adults have a choice to no ride in the car but children are stuck with their parents

I think a vehicle owner should have the right to decide if they want to allow smoking in their property…

Obviously with the proviso that if smoking is allowed, it’s only done with the willing consent of all of occupants of each vehicle....

I wonder if there are reduced insurance implications for the vehicle owner….!.

I'm an occasional smoker I suppose sums me up best.

I hate smoking around kids and like to think I'm a considerate smoker.

But as an example, a company car owner who never has to take anyone else in their vehicle. Their right to smoke or not?

This is true. In my last job I had to take a company car. Over the course of my employment I paid in excess of £23k in tax. ( aporox 7 years).

The car, to all intents and purposes is like a private car, ie just driven and used by me and my family.

Using your analogy soxy if your view is it isn't my car and I have to abide by the owners rules what else could be imposed. No dogging? . That's a joke of course but companies could be very strict. Anyway this refers to laws imposed by councils not employers.

If you are not the legal owner of a vehicle you have no mandate to decide how that vehicle is used other than what is authorised by its owner or their representative ....

Should you choose to break their trust you don’t deserve any compassion in my mind…

Surely the owner of any type of property has the right to dictate how that property should be used by the people they entrust with it's usage..

I used to run a company car and yes I paid more in tax, but you couldn't realistically run a car for the amount of tax you pay on it when you look at Insurance, Road Tax, General Repairs etc, so despite the fact it affects your tax code it is a benefit not just a cost.

The car s owned by the company and they will ultimately be responsible for disposing of it when you get your nice shiny new one, and the simple fact is a smokers car will sell for less than a non-smokers car as no matter how hard you try you can never completely get rid of the smell, plus upholstery and door trims often end up with cigarette burns on them too which can be costly to repair...nice little charge there from a contract hire company if that's how the employer buys them.

There is also the issue that in some cases a company vehicle is a place of work...I know this is not always the case, but a blanket rule is much easier to enforce

I'll put it in a simple scenario....

Driver 'A' gets into his Excel delivery truck and drives it for the week, smoking like a chimney and thinking that he isn't affecting anyone else.

The next week he is on holiday or off sick...

Driver 'B' gets into the same truck and it is like an ashtray, there is ash all over the place, he turns on the heater/cold air blower and gets covered in cigarette ash.....he goes home stinking like a life long smoker.

Now does it make more sense?

His company has a duty of care to ALL it's staff...including smokers and non smokers.

always remember a female copper in a panda car puffing away on a ciggy going round a corner and losing it,it was the way she had the fag between her fingers and was holding the wheel at the same time when she lost control that sticks burned into my mind as she headed towards me in that out of control vauxhall astra........ i'd ban smoking in vans and cars no question

i tax it fuel it insure it and its mine if i wish to smoke i will .....end of...

Having been rear ended by a company car driver as he bobbed down to retrieve his cig lighter its 100% yes it should happen. Its a distraction, nobody stops to light up or put them out. you can't use a phone and the same should go for cigs as well as food or drink while driving.

i use the remote control stereo function in my motor and i don't use the phone,i have been run over by a dozy cunt who was driving a 7.5 tonne box van for tuffnels parcel delivery and feel lucky to be here and i see it as my duty to be in control when i'm driving
