bleeding kids

I have the neighbours from hell the kids are slowly trashing my garden the balls come over all the time from their garden despite a 6ft fence. They have broken my solar lights kicked a hole in the back fence and find it funny that im getting annoyed by them climbing over the fence into my garden they used to slide the panels of the fence up until i secured them. They recently broke a pot that has a precious rose in it in memory of someone special and the mum just laughed and said kids will be kids. So now i need to stop them climbing the fence into my garden what can i legally do? If i use anti climb paint do i have to put a sign up or can i just put it up and sit back and smile as they ruin their clothes? What about spikes?

I would think spikes would be a bit far but I would definitely think about anti climb paint. Just make sure you inform your neighbours what you are doing.

Electronic shocks when they touch the fence I gt neighbours like urs but my issues is with parking out the back its now in hands of my landlady solicitors my neighbours try to intimidate me they have scared my son to the point that he wnt go out in the garden unless he knows they are out all day or away xx good luck with ur neighbours xxxx

Tack the carpet grippers ( the stuff they use to hold fitted carpets in place)to the side of the panels at the top. If event parents complain say its there to prevent burglers.

If you were to put broken glass or barbed wire up, you'd have to have a legal disclaimer in case the scum decide to try it and end up hurt.

Have you considered placing lots of turds (that'd be animal ones, not your own creations....!) on top of the fence (if possible) and in the garden where the kids usually end up?

Possibly but its all little things they will end up breaking a window then i will call the cops but they own the house it was up for sale when i moved in but its now off the market as they couldnt sell it as it was infested with mice i had the council in to sort that out as they didnt do anything. The parents fight all the time and scream at the kids so the kids go in to the garden to escape but then they drive me nuts its the parents at fault by not teaching the kids manners and respect but it needs to stop

Then the fence panels belong to the landlord. He won't be happy the panels are being destroyed. Contact your local council too or police - it starting to sound like targeted harressment. If the kids are over 10 they are bound by the law. What law, I don't know.

Its the one they put the hole in that belongs to landlord they own the other one attached to it its a corner they use to get in.

Kids are under 10 i guess they are both in primary school still

I phoned the agency and they reckon they will get back to me but they are useless the landlord doesnt seem to care as long as she gets the rent

You may have to be careful, I am not sure on the law in England but in Scotland you owe a legal obligation to keep those entering and being on your land safe... This includes those who were not invited. Putting something in place with the intent that it may cause the children injury could wind up getting you in trouble. I would get advice from your local council - they should have a team that deals with neighbour disputes. As I say, I'm only aware of Scots law so I might be speaking nonsense, apologies if so...

I am talking from experience in england, speak to your local cop shop who will give you the number of the local officer (pcos or whatever they are called) who deals specifically with neighbour disputes.. He/she will give you advice on how you can handle the situation

Oh I am sorry officers, as I was enjoying my nightly game of baseball practice at midnight I never saw the scrotes in my back garden, never would I dream that they would accidentaly wander into the path of my swinging bat as my attention wandered for a second. I do apologise, I hope they will recover speedily.

Disclaimer, I dont advocate hitting little kiddies, just scrotes on my property intent on damage/mischief.

thanks every body im sending S round next time hes here to have a word and phoning the local police to see what i can legally do. I would have thought them coming into my garden uninvited alone would be enough of an offence without them causing damage but im at breaking point now with them if mum and dad arent creating war then its the kids in my garden damaging stuff

Not wishing to sound wooly and pc (not my cup of tea) but how about a touch of 'kill with kindness'?

Youve already said its the parents fault, nurture rather than nature if you like and they are still young enough to respond to some Pavlovian conditioning.

Try inviting them in for Sunday afternoon tea, show them your lovely garden and possessions and ask them if they would like to plant sunflowers and see whos grows highest. Make sure you have another adult about.

If this does not work after a week or 2 then the anti cat spikes are great and are sold openly.

Hope you sort them out.

Tar paint is legal, councils use it... Its a twat to get off too!!

Ive done everything to be nice to them but when you are sat out having lunch with partner and the ball comes over 10 times in an hour and they are shouting at you to throw it and they break a plant thats planted in memory of my daughter you get to the point where enough is enough i have been lovely to them and bought them easter eggs and always been pleasant im trying not to be the grumpy neighbour but enoughs enough

these are kids playing in their own garden if the ball only came over a couple of times od be ok with it but when its in double figures every day and they dont even knock the door to ask for it back they just climb into the garden and help themselves damaging my stuff its not right if i went into their garden and damaged their stuff they would be up in arms

I wouldn't. You can actually have the police at your door for it. I only know as some kids were throwing and kicking a ball at my window and car. I took it in. Put a knife through it and 2 hours later police at my door and I was given the option of replace it financially or face charges of criminal damage.

I'd already spoken to the parents.

My neighbour complains about my kids if they even breathe in my garden. There is no fence and sometimes things Go over. If he is not In I let them go get it .. if he is I send them over. However if it goes over more than 3 times I tell them to play something Else.

I would try talking to the parents again. Next time ball comes over take it over and chat. I know I wouldn't have an issue with that.

I'm guessing the parents aren't cooperative? Have you tried speaking to them?

If they are renting, whether private/council, they would have signed a tenancy agreement with an anti social behaviour clause saying something like 'I will not cause alarm or distress to neighbours'

If they own their property this doesn't apply, but either way, get in touch with your council and they should be able to point you in the right direction

thanks everyone i have blocked some of their access now so will see if this works if they climb on what has been put in the way they will break it and potentially hurt themselves but thats their fault for climbing on to my green house its only a plastic one so cheap to replace but wont take their weight. I have popped round to talk to mum and dad today and had door slammed in my face so if this doesnt work i will write them a letter and advise them im using anti climb paint so if the kids climb they will get covered in it. As long as i inform them i can use it so i was told today

The Use of Barbed Wire

Barbed wire may be used to defend your property, but the law puts certain restrictions on its use.

Section 164 Highways Act 1980, says that where, on land adjoining a highway, there is a fence made with barbed wire in or on it and the wire is a nuisance to the highway, a notice may be issued by the Local Authority for the nuisance to be removed.

Being a nuisance means that it is likely to cause injury to people or animals using the highway.

In practice, most Local Authority Highways Departments usually consider that barbed wire lower than eight feet from the ground could be a nuisance to highway users.

The term "Barbed Wire" means anything with spikes or jagged projections, so would also include the wooden carpet gripper strips which have nails sticking up through the wood.

If the barbed wire is not adjoining the highway and an injury results, you could still be faced with a claim for damages under the Occupier Liability Acts. Occupiers of premises have a duty of care, to people entering or using their premises. This duty even extends to trespassers, although it is not as extensive as it is to people lawfully using or visiting the premises. So a burglar, who could not be aware that barbed wire was on top of a fence and injured himself on it, could have a claim against you despite the fact that he was a trespasser.

If you wish to have some sort of barbed wire protecting your property, it may be a good idea to check with your home insurance company that they would cover you in the event of a person claiming for an injury caused. It is for these reasons that most residents prefer to use Mother Nature's own barbed wire, a prickly bush, climbing rose or similar. A separate Fact Sheet gives advice on suitable prickly plants.

Unfortunately you can't put up anything hazardous like spikes, glass I'm afraid just prickly plants etc.

The police don't take this sort of thing seriously especially when it's a privately owned house. I would say you have very little option in the way of defence mechanism's especially if the fence panel they are climbing belongs to them!

How about a nice water feature on your side of the fence, about 2' deep and just wide enough to make it hard to jump over, can't put piranhas in it unfortunately, but a cold and wet child is not your fault

we have a large bit of green outside my house and they are NOT supposed to play ball out there, when they do and it goes over my neighbours fence she keeps the ball, frizbee etc and at the end of the summer she takes them to the local charity shop.

I used have kids climb my fence as they thought it was a short cut to where they were going, i just borrowed a friends rather large Rottweiler, and told them that i would let him off the lead if they continued climbing the fence....

It turned out to be a result and it stopped.

I do feel for you and i hope you get it sorted very soon !!

I michelle have been reading this and I just have to say I cant believe the hassle you been getting. If they were my kids who did the damage I be mortified and be paying back the cost.I wouldnt like people to say my kids are unruly. I really hope things get sorted for you. "thanks everyone i have blocked some of their access now so will see if this works if they climb on what has been put in the way they will break it and potentially hurt themselves but thats their fault for climbing on to my green house its only a plastic one so cheap to replace but wont take their weight. I have popped round to talk to mum and dad today and had door slammed in my face so if this doesnt work i will write them a letter and advise them im using anti climb paint so if the kids climb they will get covered in it. As long as i inform them i can use it so i was told today

Keep a copy for urself hun so u can prove to th that u sent them a letter xxx

Inform landlord u deserve the rite to hold rent until isues have been recticied read ure tenancy agreement it wil definately cover the isues of conflict

I known what you mean. My son was with a group of kids that damaged a fence. Now even though everyone said my son didn't kick the ball.. As he was In goal.. (not good at it I'm guessing.)

But the fence behind them got damaged. I was mortified and agreed to split the cost between me and the other parents.. in the end I was the only one that paid.

Sad world that parents don't set a better example.

How about a nice water feature on your side of the fence, about 2' deep and just wide enough to make it hard to jump over, can't put piranhas in it unfortunately, but a cold and wet child is not your fault

the police were amazing when i had a problem with our 2 privetly owned houses! they got their officer to call me who was part of the neughbour hood safety team and one of their responsibilites is neighbour disputes..

Thanks michelles and cali i know not everyone is like this with their kids i will hand letter to them as they are right next door i cant withold my rent as its nothing my landlord can do its not their fault i have crapy neighbours who havent taught their kids respect. Lets hope blocking the climbing hole they made and having an unstable object in the way will deter them for now but as i said if not then its anti climb paint and a letter informing mum and dad

Can I just suggest you carry on paying the rent....If you are made homeless due to rent arrears you may find it harder to obtain other accommodation no matter what the circumstances are. I would contact your local private tenancy unit within the council who maybe able to help you resolve this issues before

A. Some kid gets hurt

B. You start having grief off the neighbour

C. You make yourself homeless..

Cheeky dont worry im not going to stop paying my rent thats a sily thing to do i have taken sensible action and will inform parents before i do anything that will harm the kids.

I know it's radical but you are in the stronger position as you are a tenant. There are thousands of places to let depending on where you are.

Whether you think it's letting them win is debatable. But you'd get yer life back mate.

Hope you get something sorted.

Speak to Citezens Advice too. They are very good normally x

We had the same problem with our neighbours, who did not give a dam.what there son got up to, even when he was cutting the lawn at 4 in the morning then started a fire and was throwing gas cylinders on the fire, another neighbour called the fire brigade, well one can only take so much after months and months of hassle I lost it gave the father a good thumping and up went the for sale sign, must admit it's not how I wanted it to go but it did the trick

Right to be completely legal with the anti climb paint and/or barb wire, it has to be above 8 foot up and have signs warning that its there, health and safety gone mad i know, but it also stops claims in court because if anyone gets hurt by it then the first question that is asked, what were you doing up there in the firstplace? Has to be completely out of reach of the average person as a rule of thumb

I have a 10 foot high brick wall at the bottom of my garden... not the sort of thing kids could accidently get on top of. I had the police around to advise on how to protect my property from burglars.... basically even on such a high wall there was fuck all I could put on it if it had the potential to cause harm...... and the paint needed a warning sign.

I've had experience of this sort of problem before, having worked in the Security Industry.

You can use anti climb paint, but you MUST legally supply notices to show that such paint is being used. Notices must be displayed on all sides of the area where it has been applied.

You can legally use the strips of plastic spikes, you can buy at selected outlets. I did try to privately PM you with a known stockist, but you have blocks on your Profile. If you PM me, I can supply you with details.

Razor wire is a complete No-No! It is fraught with lots of legal complexities as to its use.

Barbed wire is almost as complex in its use too, but in simple terms, its use on fencing areas below 2 metres in height would surely attract the attention of the the Health and Safety people!

If your neighbours are in rented property, you can apply pressure through the landlord. So too, can the Police, as can the Council too. Landlords are responsible for their tenants behaving and councils can bring lots of action against landlords.

Speak to your local Council; there is sure to be a department which can look at your problem and assess it from there.

Start recording all the problems in a Diary. If you can, see if you can set up a CCTV camera from inside your property, maybe trained over the fence area where the kids get into your property. Visual evidence backing up your "diary" is invaluable.

If you can afford to, have a word with any local security services company. Again, if you PM me privately, I'll be happy to supply details.
