Got a speeding ticket for driving 58 on a 50 speed limit on the M62 motorway. It was the variable limit sign that came up to reduce speed, drove through it. Had a Section 172 notice in my letterbox a few days later.

I am a little nervous, as this is my first and I've had my license only 16 months. Anyone know if the penalty will be 6 or 3?

I am waiting for the Fixed Penalty Letter.

Don’t they give you the option to take a speed awareness course and avoid the points? If it was your first offence then I would assume that would be the normal thing.

Although you may be offered a course instead

If you do, take the course

The only reference to a licence under 2 years is if you get 6 points in total, it will be revoked

If they do, don't just accept it

You can seek legal assistance for this kind of thing

It may cost, but if it means keeping your licence it may well be the better option

You can, of course, choose to represent yourself and demonstrate economic hardship or similar in not having a licence (eg, your job relies on you having it etc)

I do think though, that you are worrying unduly

It's always a shock when these things drop through the letterbox

I get the tailspin, but worry about if it escalates once you have returned your plea and they get back to you with your options

As a new qualified driver your licence will be revoked if you get 6 points in first two years. This is a DVLA decision, so pleading hardship in the court will not make a difference. That option is only if you get 12 points on your licence once you are out your probation period. Chances are you'll get a fixed penalty of £100 fine and 3 points or most probably the offer of a speed awareness course as the limit for this is 10% plus 9mph. So on a 50 it would be 64. But this is at the discretion of the prosecuting authority. You can Google sentencing guidelines which give the range of penalties you get for speeding, again 3 points but costs would be more due to court costs but you can argue just to be fined £100 same as a fixed penalty. You can only do one speed awareness course of of each every 3 years as they are different between motorway and none motorway. As long as this is your first time the only chance you have of gaining 6 points and having your licence revoked is if you don't return the section 172 form identifying the driver. This is a mandatory 6 points. Always photograph the form and send recorded delivery. The other two easiest ways to get 6 points is touching your phone (even if stationary) or no insurance, each of these carry 6 points mandatory

The courses are really well made and the people who deliver them are so engaging… I worked in training many years and these guys are top notch.

I have done two speed awareness courses in my 18 years of holding a UK driving licence and I enjoyed the “live” one so much more than the online one. But of course the online is much more convenient.

I can't tell until I take the course I imagine. But getting the ticket alone has made me more aware of variable limit signs, cos I find those the most confusing. Especially when they tend to pop up and you don't see the "End" sign for the next several miles and everyone else seem to be back on regular speed.

You’re 1mph over the 10% + 2 guideline. You should get the option for a speed awareness course if it’s your first offence. They’re not as bad as you think.

Just be sure you have the correct venue details for the course. This will avoid the need to do 125mph on the M5 at 08:45. Still, at least I wasn’t late…

You’re 1mph over the 10% + 2 guideline. You should get the option for a speed awareness course if it’s your first offence. They’re not as bad as you think.

Just be sure you have the correct venue details for the course. This will avoid the need to do 125mph on the M5 at 08:45. Still, at least I wasn’t late…

(for others reading, it's basically a specie of fish that have very poor vision)

I wouldn't mind changing it to that, but mehn, I've looked at images of the fish and they don't look very "handsome". Definitely not the best of the pile myself, but I like to think I'm not as ugly.

I drive a taxi, and our prebookings are dispatched via a mobile phone app. I’m sure you can see where I’m going with that??

Might not be the best person to answer this, but I'll give it a shot.

The was this traffic policeman on Tiktok that was explaining the different nuances. Apparently according to him, mobile on a cradle still counts as use of mobile. He admits it's a bit silly since most mobile cars have smart dash systems that can even be more distracting than mounted mobiles, but the law hasn't been updated much. And depending on the policeman that stops you, he could let you off if he's nice.

He advises that it's best to stop and park to set your map or use your mobile on a mount if you must.

It did!

To be fair, the second time I was in a new car in 2022 where really you don’t feel how fast you’re going… it was a 35 in a zone quickly going from 40 to 30. Not an excuse and not good at all. But I am much more aware now. I go on the M25 every day I work so am very aware of how bad accidents can be.

"As a new qualified driver your licence will be revoked if you get 6 points in first two years. This is a DVLA decision, so pleading hardship in the court will not make a difference. That option is only if you get 12 points on your licence once you are out your probation period.

Chances are you'll get a fixed penalty of £100 fine and 3 points or most probably the offer of a speed awareness course as the limit for this is 10% plus 9mph. So on a 50 it would be 64. But this is at the discretion of the prosecuting authority. You can Google sentencing guidelines which give the range of penalties you get for speeding, again 3 points but costs would be more due to court costs but you can argue just to be fined £100 same as a fixed penalty. You can only do one speed awareness course of of each every 3 years as they are different between motorway and none motorway. As long as this is your first time the only chance you have of gaining 6 points and having your licence revoked is if you don't return the section 172 form identifying the driver. This is a mandatory 6 points. Always photograph the form and send recorded delivery. The other two easiest ways to get 6 points is touching your phone (even if stationary) or no insurance, each of these carry 6 points mandatory

So which season of Police Interceptors did you star in, cos I’m sensing Traffic levels of knowledge here…?

Off topic question… where does the law stand on using a digital device while it’s mounted in a cradle??

Let's just call it an " interesting hobby".

As for your question, the offence is operating/touching a transmitting device, irrespective of where it is, so it doesn't matter if it's in the cradle, your hand or even the passenger seat and you don't even have to be moving, eg, sat at traffic lights. (People (cyclists) are even filming people at traffic lights and sending into the police for prosecution). Ironically if you are operating a sat nav as opposed to the sat nav on your phone, that's not an offence, neither is operating your phone from your steering wheel etc. It's not the world's best thought out law.

To be safe, take your pre booking whilst parked up and then don't touch your phone whilst moving

Might not be the best person to answer this, but I'll give it a shot.

The was this traffic policeman on Tiktok that was explaining the different nuances. Apparently according to him, mobile on a cradle still counts as use of mobile. He admits it's a bit silly since most mobile cars have smart dash systems that can even be more distracting than mounted mobiles, but the law hasn't been updated much. And depending on the policeman that stops you, he could let you off if he's nice.

He advises that it's best to stop and park to set your map or use your mobile on a mount if you must. "

Here’s the problem, I actually CAN’T stop to use the device. I have 59 seconds to pick up a job before it goes to another car. And I’m not even driving for (sorry for swearing…) uber.

I’m relying on the hardware provider to have done their due diligence, and made sure it’s all legal?

I do recall some sort of caveat, where a driver can use a mounted device if it only requires a single button press.

100% agree about modern vehicles and interactive screens though!!! Having an iPad set into your dash is madness!! Ultimately, it’s cheaper for a manufacturer to fit a screen, and have as much functionality for the vehicle as possible operate through it. Saves money on designing, and finding space for a collection of buttons.

They’re even harder to operate in a RHD vehicle with your left hand!!!

Having said all of that, it’s now far less likely for my partner to reset the sat nav, turn up the radio, or make a phone call while I’m getting road-head. (thought I’d better bring it back to a fabs-friendly post!

You’re right though… crazy rule! The kit is all broadly the same across the industry, and I’ve never been 100% confident that it’s legal…
