"Anyone had to go through this and how eaay is it do you need sokicitor involved, and what are costs of claiming" Small claims court was reformed a few years ago and it’s now an online money claim. No, you don’t need a solicitor but rarely it’s the last resort, bear in mind you will lose your costs when they settle out of court on the day or before Its binding too - this is why companies hardly ever ever use it, & why parking tickets will hound you for years through different agencies threatening to do it and never do, finally giving up . Who are you trying to get money from and how much and why? Your best bet is always negotiation. | |||

" Be careful to mark everything ‘without prejudice” if doing that, otherwise if the worst happens, you could lose out. Often it’s better to do things verbally with no witnesses, get to the point of agreement and then put something in writing to that effect. Because there are also things you might want to say to influence the decision that you would not want to put him writing. | |||

They got a CCJ, she got her money, with interest and costs. They paid up though, no need to chase them with bailiffs. Gbat " So in my case the other party did not pay; we won the case automatically. The other party appealed the automatic win as claiming we didn’t issue proceedings properly and he don’t have time to fill in appeal . They were issued with the information we had at the time. (Residing address vs rental address), we had asked for residing address he refused to give it. So as the property was still in his name with the land registry we issued to the property he was renting out. Tbh he got a ccj and paid but even the payment took a year as he didn’t want to pay and tried to say he had paid some of it but hadn’t and the court info was being split between courts | |||
