I’m not sure about this but I think it’s standard protocol that women are searched by female officers and men are searched by male officers, so I assume that if you had said that you identify as a woman you’d have been searched by the female officer. Probably asked you before you did the breathalyser as the situation was calm and could have escalated if you’d failed and there might not have been an opportunity to ask then. Wondering though who would have searched you if you’d said you identify as non-binary? Would either of them or neither of them be allowed to search you? You’d have been arrested and taken to the police station and everyone they arrest gets searched before they put them in the car. How did they know you hadn’t been drinking? If they knew you hadn’t been drinking why did they breathalyse you? They don’t breathalyse everyone they stop so they don’t breathalyse people they stop for having a light out. If asking how someone identifies is now part of the breathalysing process and should be asked prior to the breath test being done then they will ask everyone prior to making them do a breathalyser, even if it’s just a pre Christmas campaign and even if they’re 99% sure the person hasn’t been drinking. If they don’t follow the process they’re told to follow and something goes wrong then they’ll be in trouble. | |||

It is weird that you were breathalysed after being stopped for having a faulty light, that’s not normal at all. I’ve been stopped a few times for various different reasons by the police and have never been breathalysed. But what I said is still relevant, the reason they asked if you identify as a woman was probably because you would have been searched if you’d failed the test. | |||

I’ve been stopped a few times for various different reasons by the police and have never been breathalysed. They clearly knew I hadn’t been drinking and were just going through the motions as a big pre Xmas campaign in this area to breathalyse so doubt they expected me to fail. Been stopped before for lights and never been breathalysed. Perhaps standard protocol to search after failure now. It’s a strange old world. It is weird that you were breathalysed after being stopped for having a faulty light, that’s not normal at all. I’ve been stopped a few times for various different reasons by the police and have never been breathalysed. But what I said is still relevant, the reason they asked if you identify as a woman was probably because you would have been searched if you’d failed the test. I think they said at the moment they are breathalysing everybody who commits a road traffic offence which technically I had even through they let me off. Actually they hasn’t even pulled me over. They were in Stansted airport MacDonalds car park, perhaps just had lunch, saw me drive in with one light out and waved me over and started asking me why I was there. I said I’ve just come to get a Big Mac and fries " It doesn’t matter where you were or why you were breathalysed, if the standard protocol is to ask prior to making someone do a breathalyser then they still would have asked you and if you had failed the breath test then you still would have been arrested and searched. Asking you why you were there is however very much against standard protocol and breaks the Criminal Justice and Public Order Act. They had no reason to question why you were there as you hadn’t done anything to give them reasonable grounds for suspicion, having a faulty light allows them to alert you to the fact that you have a faulty light, check the rest of your car for any other faults and if there aren’t any then they should instruct you to get it fixed as soon as possible. They have no rights to question you any further than that and you aren’t under any legal obligation to explain to them why you’re in a McDonalds car park. To me, asking you why you were there is more alarming and unreasonable than asking if you identify as a woman. | |||

"I’m guessing that as there was a male and female police officer there she asked so that they know which of them would have searched you if you failed the breathalyser. I’m not sure about this but I think it’s standard protocol that women are searched by female officers and men are searched by male officers, so I assume that if you had said that you identify as a woman you’d have been searched by the female officer. Probably asked you before you did the breathalyser as the situation was calm and could have escalated if you’d failed and there might not have been an opportunity to ask then. I’ve never heard of this happening before and I’m only guessing, but maybe this is standard practice now when in a situation that could lead to someone being searched. Wondering though who would have searched you if you’d said you identify as non-binary? Would either of them or neither of them be allowed to search you? Would they have had to request a non-binary police officer went there to search you…. Perhaps but why would I be searched if I had failed?
