Well written ones will likely say that by being a member of this site, you waive the right to bring a complaint against the site or its members for receiving unsolicited adult content.

I suspect this would require a test case. Somebody on here would have to report an incident to the police and the police would have to investigate and get the identity of the perpetrator by getting the site to divulge the phone number they have registered with. If they take that seriously enough, they would take it to the CPS who would decide if it's in the public interest to prosecute and then go to court.

I suspect that on a swingers web site it wouldn't get that far. It may not even get off the ground. The police have their hands full already. This is aimed at a different group. So even if it is technically illegal on here, I can't see the authorities taking it seriously.

People are conflating things.

Fab will be covered by 'intermediary liability' laws similar to Section 230 in the States

Fab is very unlikely hold liability for what it members send each other and have provided a robust moderation and reporting structure.

If a fan member decides to report another member to the authorities for sending an unsolicited dick pic, then it is very likely to be covered under the new law.

I could be wrong but that's my read of it.

Again, it holds no weight when it comes to a pornographic site (not social media). The entire premise of such site (categorically) is that you will see genitalia - victim blaming or not it is the nature of such a website. And this is likely what the law will view - pornography site.

On a social level you are right, but lawfully unless it's made specifically clear thatit applies to any and all private messages regardless of site type it won't be impacted regardless of unsolicited or not.

The new law amends section 66 of the Sexual Offences Act 2003.

I am summarising, but it says it's an offence to send to another an image, film etc of genitals, if the sending was intended to cause alarm, distress or humiliation.

OR

The sending was for the purpose of sexual gratification, and the sender was reckless as to whether the sending would cause alarm, distress or humiliation.

There is no exemption for sending on a pornographic or sexually explicit site.

So from the wording, unsolicited dick (or vag) pics could fall under the new offence.

Under the proposed legislation announced on Sunday, anyone who sends a photo or film of a person’s genitals - "for the purpose of their own sexual gratification or to cause the victim humiliation, alarm or distress" - may face up to two years in prison.

You might be alarmed or distressed, but you would have to prove that they intend to cause alarm or distress. As this is a swinging site you would be very unlikely to.

Fab itself falls in to an overlap, it's pornographic but also social media. There is a chance unsolicited may not apply to porn sites, which would make sending of such a none crime.

Not unless it's stated as law. The law may not apply that to pornographic sites. It all depends on the wording of the law.

Pornographic sites may fall under a case of you entered the site knowing genitalia will be seen regardless where. I'm not say that will be the case but because of how laws require very specific wording to work, I'd not be surprised if it won't apply here.

I’d say probably not. Prosecutions only get through if it’s got a good chance of conviction and it’s in the public interest. Sending a dick pic on a sex site 9/10 times is presumably done to try and entice someone to have sex with said penis. I don’t think you’d be able to prove an intent to cause distress

Other pornographic sites where users can send each other images blur the image and the recipient choose if they view it or not. Fab does not have these safeties in place. Given this change if law it probably would be wise for it to do this.

No but the other aspect of illegality is that it's been done for the sexual gratification of the sender, not *just* an intent to cause distress.

How they'd go about proving it is another matter but is probably the flip side of the argument "He's on a sex site so of course he's done it for sexual gratification".

The "it's a sex site what do you expect" defence would mean you can't have it both ways where a female shouldn't be distressed by it AND also say that the male wasn't doing it for sexual reasons.

I’d say probably not. Prosecutions only get through if it’s got a good chance of conviction and it’s in the public interest. Sending a dick pic on a sex site 9/10 times is presumably done to try and entice someone to have sex with said penis. I don’t think you’d be able to prove an intent to cause distress

No but the other aspect of illegality is that it's been done for the sexual gratification of the sender, not *just* an intent to cause distress.

How they'd go about proving it is another matter but is probably the flip side of the argument "He's on a sex site so of course he's done it for sexual gratification".

The "it's a sex site what do you expect" defence would mean you can't have it both ways where a female shouldn't be distressed by it AND also say that the male wasn't doing it for sexual reasons.

As has been said above it's not just about causing distress. The new law also separately covers that the sender has done so for sexual gratification. The 'nature of the site' that you use as an excuse on one hand now becomes a reason for prosecution on the other.

My point would be how desperate to send a cock pic would you have to be that you'd want to risk being reported given the potential consequences?

Also, I forgot to add. Most ISPs by default, block pornographic content. This relies on a trust model with the website classifying itself correctly.

Fabs seems to do this, if my filters are on, I can't visit the main page. I've also witnessed odd behaviour to do with switching between an non filtered isp to the filtered isp while still logged on Fabs. I can see the text content but any images aren't loaded.

What this means is, anyone who wanted to go on a porn or fabs like entity would have to unblock that content specifically with their ISP - in some ways - it could be argued that there's a level of complicit acceptance when you've jumped the hoops to get it all
