Hi everyone

In need of some advice, I have just put a deposit on a new can and was told it would come with a 12 month MOT and it was put through the MOT today and failed. So does this mean I pay for it fixing or the people I’m buying it from pay. I’m unsure after being told I’d have it was 12 month MOT but on the deposit receipt it says I am responsible for any expense incurred by the seller in preparing any advice would be greatly appreciated

I would say no.

It's down to the seller to pay for any work as you are expecting the car with a certificate, not a failure

A deposit is just a deposit, if you haven't signed any paperwork declaring yourself as the legal owner you're not liable to pay for costs for a failed MOT

Also if you can, refund the deposit and find another car, being a car enthusiast myself I won't trust a car I haven't already owned failing it's MOT

Check the wording on the receipt for the deposit. I'd agree with above and walk away, but then it might have failed on something minor like a bulb.

Worst case scenario, you walk and lose your deposit
