The company's approach to the design and production of the sub seems to be questionable, which then makes you wonder about the maintenance regime / was it tested for stress fractures, etc after the previous dives. The only good thing is that those onboard wouldn't have known anything about the implosion and would have died instantly, though its heartbreaking to think that they knew they were in trouble with little chance of rescue beforehand. In international waters the state that the vessel is registered to has legal jurisdiction (in this case its Canada). Yes, the lawyers will have a field day and waivers can be overturned. Bear in mind the wealth that the victims had and the financial capabilities of their families to pursue this. There is also the possibility of a class action, where they could combine their financial resources (though in reality, this wouldn't be necessary). However, this all relates to civil proceedings and there is the potential criminal negligence side, which cannot be avoided with waivers. Corporate manslaughter does not exist in Canadian law, but criminal negligence does and this can apply to individuals within a corporation, so undoubtedly the authorities and lawyers will be looking into this too. | |||

His argument was the track was in a dangerous condition. Our argument was you’ve signed a waiver, you knew the track, yet took part so don’t have a case. The waiver was produced by international motorsport authorities, approved by our insurers, and used widely. The judge ruled quite quickly that the waiver was null and void because it required the signatory to sign their rights away. We lost the case. So, waivers… not worth the paper they are written on. In this case, it was a commercial operation. They paid money to a (I’m assuming) US company. International waters doesn’t matter… if negligence can be proven. The families and the businesses behind them have resources to take action against the company to make good their financial losses. Regaling their final moments, a hull failure at that depth would be catastrophic… it is highly unlikely they would have even known that they had a problem before imploding. There will not be anything to recover. | |||

Our understanding is the Canadian ship was hired by the sub company purely as transport. Not as any form of support or base of operations. The sub was untethered, fully autonomous, and owned and operated independently of the ship company. That makes the transport ship nothing more than a man-with-a-van. If you got someone to transport a piece of kit from A to B, hang around while you use it at point B, then take you back to point A; they can not be held responsible if that piece of kit is knackered and you nominate yourself for the Darwin Awards that year. It's got to be entirely the responsibility of the sub company and design engineers. Unless the construction company also had any input into the design and operational specs, they are also off the cook. | |||
