My thanks to a couple on the "Why? " thread....

With regards to snow clearance..... The Government website states the following:

" You can clear snow and ice from pavements yourself. It’s unlikely that you’ll be sued or held responsible if someone is injured on a path or pavement if you’ve cleared it carefully."

This is followed by practical methodology....

I live and learn.... Damn, no excuses now...!!!

Hence the phrase " if you have cleared it carefully" in other words you could think its done carefully, the person that has fell may well disagree and sue anyway.

Shouldn't councils do it, isn't that one of the things we pay an extortionate amount of council tax for!

why thank you but one doesn't go oot when the white stuffs on the ground...I hibernate ....but you could do my neck twisted that yesterday morning just turning in my bed....and its still stiff and painful

To my mind I am responsible for the path leading from my front door to the pavement, but as it's my property you enter it at your own risk. I wouldn't clear the pavement as it's not my responsibility, plus I know there's dog shit buried under that snow so fook that.

I doubt it as that would open the flood gates then. The same reason as to why the would never entertain a case against a first aider who broke simenes ribs giving then CPR, sometimes common sense does prevail.

There is two known cases in my area where first aider has been successfully sued, first case company stepped in and paid compensation out, second case a lot more serious, as first aider administrated epipen in wrong area which resulted in fatality. First aider was found guilty at court, and case is currently undergoing appeal

That which is reasonable being the key phrase in all duty of care legislation....

Cases like that worry me. All it will mean is that people will be scared to be first aiders because they don't want to get sued.

The reality and practicalities of suing someone or an organisation are not as straightforward as no win no fee companies would have you believe. Even very genuine cases where clear negligence has been established by the HSE can be extremely difficult, stressful and time consuming to pursue. The fear of litigation is far greater than the likelihood of it happening.

I haven't been able to post for giggling!

But I agree, the main paths should be done by the council, but because of cuts, they are struggling to do even side roads and are asking us to clear the section of path in front of our houses. As I live at the end of the road, I have a hell of a bit to clear - I just gritted it

I cleared mine and my elderly neighbours including their drive.

Id rather help them out instead of worrying about being sued, if I get sued I'll reconsider how helpful I am in the future

Can we just clarify (again) NO ONE has ever been sued successfully for this!!!! It's a Britain's gone mad approach which is often evidenced by poor journalism, gossip and misunderstanding. Talking to your mate down the pub is not evidence, it's gossip.

People who sue? Please - doubtful they would win. Did they not notice it was icy and cold? How did the snow take them by surprise? They are responsible for how prepared they are and should take care.

Oh my goodness I feel like the world is going mad. If we all cleared in front of our houses it would not take long, I even clear the neighbours across the road. the threat of being sued is there for most things, but if you let that stop you what an anti social and boring life we would all lead.

Sounds like an excuse for laziness for some.
