Fairly normal people can quickly turn barbaric given the chance , whether it’s joining ISIS, a war or forumites ready to torture criminals.

Yes it would be cheaper for sure. But there’s always the risk of killing the innocent, at least with a wrongful conviction there’s freedom and recompense afterwards. Death is pretty hard to undo

There was a question around this earlier as to whether this individual would go to a male or female prison due to transition status. Personally, I'd go for female prison. Cant see him lasting very long in there tbh though hed probably be protected from the general prisoners, more the pity. It's a mockery when the likes of that is protected

Some would argue muggers should be hanged, other that they shouldn’t. If you’re hanging all murderers are you hanging the manslaughterers too? The accidental death-causers?

Fundamentally I think questions like this become about punishment- what the point of them is. Whether the punishments we currently have are adequately serving their purpose. Whether the possible alternatives are what most people actually want. Also about what powers we’re willing to give to the state or a state body - allowing the state to murder its citizens is a slippery slope obviously.

And the trouble with hierarchising crime is that it’s hard to draw a line that says ok these crimes are not *THAT BAD* - not as bad as something else that does warrant the death penalty

problem with that is it takes a surprisingly small amount of evidence to charge and convict someone of a crime its not like on tv and almost all curcumstantial its insane thats not me saying they didnt do a crime i didnt read it but im talking generally from what iv seen of it

I don't think castration is too severe for what this person has done. As to who would do it, I don't think we would be short of volunteers but it would most likely be performed by a surgeon.

Nothing else to do but jail him no doubt for the rest of his life now, which I'm sure he'll get as he can only be released if he's safe. He seemed to think he could do this with impunity, which means he's likely fucked up in all ways - so he'll probably be in for his remaining days I expect given his age.

It costs money to monitor people too, there is just no way of avoiding the costs of crime - it's just the cost of modern life, the cost of our general safety. Capital punishment (which is known to be only a punishment for its level of crime, never a real deterrent) in itself costs a fortune, and if you do that to this person we'd be putting to death hundreds a year all told. pt

With the history that our criminal justice system has regarding miscarriages of justice and wrongful conviction/imprisonment, this isn’t the answer.

The cost of such a punishment alone would be astronomical and we have a justice system that is already failing, from the police through to the courts, under the weight of decades of financial cuts.

But they were kids, and with horrible backgrounds. But they were perceived as "naturally evil" and many people wanted them dead.

That may be. I’ve not read the parts of the case that have been put to the media let alone the parts that are kept from it, but implementing such a punishment for this case would mean there would have to be a widespread introduction for this as a possible sentence in all cases similar to this, or for the 2 given by the commenter I responded to.

It’s not about one case, it’s about all cases going forward and what precedents decisions like this could introduce.

I’ll put it another way, if you were wrongfully accused and brought up on charges like this, or indeed murder, would you like your odds if capital punishment was put on the table by the prosecution, as their hopeful sentencing outcome?

My friends are actually Kurdish, one guy in particular was in the peshmerga, fought against the Iraqi army, was shot, almost died and came to the UK for life saving surgery. He says it was better before and that's good enough for me.

The Judge will sentence him in line with existing sentencing guidelines. That is what he is allowed to do within the remit of the law.

We do not have the death penalty in the UK.

Some states do have the death penalty in the USA. Does that stop crimes like these happening ? No, of course not. Ergo the death penalty is not a deterrence.

Someone earlier said, "What does he contribute to society?", and the implication is that he is a drain on the taxpayer.

Actually he does contribute to society.

A prison guard(s) have jobs because of him. The workers in the kitchen have jobs because of him. The prison medical staff have jobs because of him.

A whole tranche of people are needed because of him. They have jobs and families to support.

So something good can come from evil.

I don't think I'd ever be comfortable with killing someone as a punishment - I'm better than that, but I think an offender may prefer it to what I believe should happen to these sick individuals.

A full life sentence, hard labour 14 hours per day, 6ft by 3ft cell, no lighting, no tv, no books, no hobbies, no visitors, no interaction with other prisoners, no pandering to religious, cultural or dietary beliefs, basic nutrition and water only and permanently gagged and shackled hand and foot when not in the cell.

This, of course for only the worst of crimes, proven beyond all doubt.

What ever they do I just hope two things, one, make sure it costs the tax payer as little as possible, there's more deserving people out there who need the finance.

Two, target his human rights, go straight for them like an exocet, dehumanise him, make him suffer, don't worry about rehabilitation as if he ever gets out make sure he knows that one sniff of wrongdoing then he's back inside, no future trial, just straight back for a long stretch or possibly ever

I’m not ignoring it, I addressed it. It’s not about these cases, it’s much more wide angled. You have to look from an overarching point of view, how this one change in sentencing law can affect all cases and trials going forward regardless of outcome. That’s the point you’re missing, or indeed ignoring.

Yes, it’s a very emotional topic, and it’s difficult to view it from any other point, but it has to be viewed without emotion when looking at justice system reform and changes to law.

The majority of those sentenced were black. When asked about this, and the zero-relationship to these executions and the levels of actual crime, he said "I know, but this is what the public want".

It's probably the most honest thing Bush Jnr ever said, though it chills me down to my bones of course.

OK, let's say I believe you and we introduce the law. How do we set the bat on what is a "slam dunk 100%" conviction verses one we're not so sure about? Do we get a bunch of Internet strangers to read a news article or two and decide which convicting are safe enough to warrant the death penalty and which we think have the possibility of turning out to be a wrongful conviction?

Not wanting to murder someone as punishment isn't basically the same as saying it's OK at all. I know you're struggling to grasp this notion but not everybody is motivated by revenge. Killing someone for a crime they've committed does nothing to undo the crime, it doesn't un-r@pe a victim, it doesn't bring a murdered person back to life. The only thing it does for a victim is satisfy those for whom revenge is important. I'm not motivated by that. I'm motivated by having a safer society where crimes are less common. In the US you have many many times more people per head of population in prison, you still execute people and yet you also have 5 times the murder rate that we do in the UK. I'd take our less than perfect justice system along with my 5 times less chance of being killed any day of the week. That is a far better solution than merely satisfying my blood lust.

That was always going to happen at some point though, esp in Scotland at present. My gut instinct is to want him dead.

However having watched different debates and discussions on the issue of the death penalty, an argument against is how this would influence future offenders. If they know that child r@pe would automatically mean the death penalty then there is a greater likelihood that they would kill any child they had assaulted.

Another solution is just to throw them to the wolves. No special treatment or protection in prison.

Fuck him. I hope he suffers every day in jail.

some states do some do not have it. There is no deterrent anymore. Some people think what is the worst that can happen. I go to prison and get 3 meals a day and free housing and medical . That's enticing.

I understand this may come off as an admission of such a thing, however, as a family member of someone who has endured a similar experience I hold no remorse, sympathy nor empathy towards the vile scum perpetrating such acts.

Only the most barbaric consequences should be given to those undertaking such acts.

Such an ordeal leaves someone with scars that last a lifetime that may not ever disappear- such suffering created by an individual who cannot/did not consider the effects of such an act all in the name of lust.
