Legal experts….This toaster is broken, I swapped my toaster for this one, with someone on this forum. My old toaster still works perfectly as it has a lifetime guarantee

I won’t name her but she is being mean and won’t swap back. I’m in the right yeah ? She should give me my toaster back or replace it ?

Grrrr…. I just tried fixing it with a fork and now the music stopped on Alexa and all the sockets stopped working. I really don’t know what to do. This days going from bad to worse

On the face of it, you made a fair swap with no grounds for changing your mind.

However, if there was strict understanding that her toaster was in working condition, then you have grounds for asking her to return your toaster.

Think of it like buying something off ebay. Once you bid and win, then you are obliged to go through with the deal, unless the condition of the item is not as advertised or is misleading in some other way.

In either case, if possible, examination of the item should have occured prior to purchase.

So it’s big and I had limited space - microwave , coffee grinder, coffee machine just wasn’t practical to have a massive toaster on there too but now I have redesigned and made a coffee station in the dining room

You have no legal right to the toaster that you once owned.

The person you swapped with is under no legal or moral obligation to re swap.

It is my belief that the toaster now in your posession broke in your posession and as such you are responsible for it breaking or it simply gave up the toast ( couldn't resist ) IF said toaster was still working you wouldn't be hankering for a re swap.

Given those circumstances I'd say you're just gonna have to bite the bullet and buy a new one. Or.....just plug it in, wait til it catches fire and then just use a fork to hold a piece of bread in front of the flames.

You didn’t give it, you swapped it this is “consideration”. You have a contract.

Caveat emptor applies (buyer beware)

You're stuffed. You can’t get it back unless you prove she tricked you in to accepting faulty goods.
