Chelmsford

Reports that a refuse collection company from Brighton, which was once called the English Gay capital, has been ordered to change its name by the Lord of the Rings copyright people. The company had a slogan of, one ring to remove it all, but they cannot afford to fight the big corporation and will change.

What the hell is going on here guys. This is all over the news

Somehow I doubt anyone would confuse a well established fantasy epic with a local bin collection company. I'd say they'd probably be safe*

Ive just spent three hours stood outside their office in my Frodo costume, hoping to get some autographs.

They have apparently been sent a cease & desist letter by solicitors acting on behalf of Middle Earth productions - who own the FILM rights, not to be confused with the Tolkein estate - who ultimately own the copyright - though that would be debateable as copytight only applies during lifetime of the creator.

However.

If the bin company were to refuse (pun intended) to change their name, it's unlikely that the Film company would be able to successfully challenge them legally as any court will consider if the general public would somehow think that the bin company was somehow in anyway shape or form connected to the films - which would be a requirement for the film company to successfully claim damages.

I suspect that the lawyers already know this and are simply hoping their cease and desist letter will scare them into changing the name.

To provide an example, back in the early 1970's a Manchester based TV studio that producedsuch shows as Coronation Street took the Ford Motor Company to court in an attempt to prevent them from naming their new executive car 'Granada'

I don't think I need to explain how that turned out
