Biscuits are subject to VAT, but cakes aren’t… so HMRC took McVities to court on the grounds that they were sized and sold in packets similar to biscuits so therefore should be treated as such… | |||

The missing and really sad context is that chocolate coated biscuits are considered a luxury item (I assume plain are essential foods) and are charged VAT, whereas chocolate coated cakes are not. Hence the reason it went to court..they made a bit one. They also argued a key point is that cakes go hard when stale whereas biscuits go soft. Right....I assume youve all now cum...so my work here is done. | |||
