Getting ripped off by employment agency

Is this common? I am trying to get holiday pay of them after leaving their employment.

They owe me £300

They provide free advice and dispute resolution between employers and employees. And will be able to help you

I would send them an email telling them that they have until a certain date to pay the owed fund's and if not you will be taking the matter to a solicitor and small claims court and state they will be liable for any costs incurred by yourself also.

Give them a time to respond and a time to pay.

If they don't respond go for it.

Just resolve it with them , it’s really not hard. It’s probably being processed and will come next month and you just don’t understand the process.

The last thing you want is legal action and definitely my not a solicitor for a claim of £800 the best fees you could claim would be around £140 which is about 30 mins time of a para legal . People telling you this generally don’t know what they are taking about and haven’t sued companies. I have sued several and it’s always the last resort

Acas Can be helpful for some things but not for this really. It’s likely jusr the way the agency’s processes work and you need to be patient and/or deal directly with them

I imagine a strongly drafted email to HR threatening legal action or stating your legal rights might get them to pay you what your due.

Generally a lot of organisations and stuff bank on people or knowing their legal rights.

Btw - It’s no longer dealt with by small claims it’s called online money claim. For £800 they won’t swayed more than around £140 plus interest. What generally happens if you do this route and they settle on the day of the hearing or before leaving you will a bill is you used a solicitor. If you refuse those settlement they can state this at the hearing and you could be given court costs directly for wasting the courts time

Very patronising to imply this is all down to OP not understanding payroll processes or being unable to pick up the phone and ask them himself. There's every chance the agency is willfully withholding monies owed and refusing to communicate. That kind of scenario is hardly unheard of, is it?

OP - your best port of call right now is ACAS. Give them a ring and they'll advise you.

What reason are they giving for not paying you, are they saying they don’t owe you £800 and offering another figure or are they saying they don’t owe you a penny ?

Post your version of what’s happened,,it’s a bit vague

As far as I understand it, almost all workers are legally entitled to 5.6 weeks’ paid holiday a year (known as statutory leave entitlement or annual leave). But... an employer can choose to include bank holidays as part of a worker’s statutory annual leave.

Employers used to be able to include this in hourly pay but that is no longer allowed and in case where it still is, the contract should be renegotiated.

These things are always best talked through with HR or a supportive manager but of course that may not always be possible.

It most certainly used to be usual when both myself and my sister worked for agencies but neither of us have done so for many years but it doesn't surprise me that this is still happening.

Get those sheriff's involved that are on the TV sometimes ,but that wouldn't involve taking them to court first .

Have you spoken to acas or anyone like that see what your options are ?.I hope you can get it sorted.

Most agencies deducted money from you weekly pay and put into a holiday fund to cover holiday pay.

Essentially it's his money not theirs.
