There's no argument, they're cakes.

Cakes go hard when they are stale,

Biscuits go soft when stale.

Saying that, they're one of the few things that I miss from home and I will order them every now and then...

Yeah, it was actually Mcvities who went to court - regarding jaffa cakes - for this very reason.
