serious question about abu hamza and all the other human rights issues, if the courts decided the government couldn't deport him, but the government said sod it we're kicking him out anyway!

what would or could actually be done against the government??

Since the days of agreeing the Magna Carta the ruling classes have enshrined as a backbone of our society the respect and finality of the law for every citizen whatever his/her story or means.

Breaking this fundamental building block of our country, which has hugely influenced the wider world, for the likes of Abu Hamza is simply inconceivable.

That said, (I would imagine that) if hypothetically our Government ignored the decision of it's own High Court. Hamza would in his absence still be able to take a new case to the European court of human rights, they would almost certainly back the high court decision which would confirm the Govts illegal act which would potentially lead to UK breaches of our European treaty. Potentially it could be a big deal, Hamza simply isn't worth it.

They had a similar situation in France a couple of years ago. Went to their high court, the terror suspects announced they were going to appeal to Europe and France had the balls to say go for it, meantime sending said suspects back to their countries of origin.

The Queen could always over rule and kick him out, it is a constitutional monarchy and she does have that power, although never used by a ruling monarch in this country.

Actually, she did step in in this case. BBC apologised for letting this be public knowledge.
