A cake goes hard when stale and a biscuit goes soft. Jaffa cakes go hard so are cakes.

Jonuts are soooo good they’re almost better than s... - no - hang on - they’re good but not that good

Maybe call them a soft biscuit - like them amaretti ones? x

I actually haven’t tried the Jonuts but they looked pretty good... but yeah not that good x

Tesco’s four of them for £1.50 I think couldn’t eat more than one I could eat a packet of Jaffa cakes you can but you might be disappointed

I haven't tried the pineapple, there's blackcurrant also of which I'm yet to try. I'm just not living life to the max at the moment

Love this post! Often comes up in conversations so I always enjoy re-quoting the following...

Believe it or not, the question of whether Jaffa Cakes are cakes or biscuits actually became a matter for the courts to decide.

In the UK, value added tax is payable on chocolate covered biscuits – but not chocolate covered cakes. McVitie’s classified Jaffa Cakes as cakes, and in 1991 had to defend this categorisation in a VAT tribunal.

The government explains, Customs and Excise had accepted since the start of VAT that Jaffa Cakes were zero-rated as cakes, but always had misgivings about whether this was correct.

“Following a review, the department reversed its view of the liability. Jaffa Cakes were then ruled to be biscuits partly covered in chocolate.”

At this point, McVitie’s appealed against this decision, prompting the VAT tribunal.

Jaffa Cakes were assessed using the following criteria during the tribunal:

- The product’s name

- The ingredients

- The product’s texture

- The texture of the product when it goes stale

- The structure of the product

- The size of the product

- How the product is sold in shops

- How the product is marketed

The court found in favour of McVitie’s and stated that, legally, Jaffa Cakes are considered a cake, which means that McVitie’s doesn’t have to pay VAT on Jaffa Cakes in the UK.

I read a site that put this to bed it’s a cake.

It went to court and is a point of law simply because biscuits are vat rated and cake is vat exempt.

The court decided a Jaffa cake is a cake and not a biscuit
