Does anybody work in HR or employment law?

Bit of a story but;

A good pal of mine worked somewhere and left under a bit of a cloud. They then went onto a new job with excellent references from the previous employer.

They then (about 6 months later) applied for another job, successful at interview and awaiting dbs and adequate references.

Current employer gave an exemplary reference.

Previous employer (who had left a good one before) gave a bad reference meaning that my buddy couldn’t start the new job.

Now I feel it’s a bit sneaky and underhand, and that the last firm gave them a good ref to get rid of them, but can a firm subsequently give a bad ref after giving a good one? Costing that person the job they’ve just been successful in getting?

Try ACAS, free employment law advice. But unless the reference was misleading or inaccurate there will be nothing they can do

I didn’t think you could give someone a bad reference unless someone has something on their employment record anyway such as a disciplinary or excessive absences or similar.

People tend to just stick to a template reference and try and tailor it to the individual.

How would they know they’ve had a bad reference? It’s not something you would tell a candidate, you’d just say they were unsuccessful. They don’t normally give specific reasons.

Contrary to popular belief a employer can 100% give a person a bad reference is what has been written is believed to be true by the company. Depending on who at the company gave the good reference that does not stop a manager or someone with a different relationship with the person to give a somewhat different reference. It all depends on who has written the current and previous references

if i wasnt happy with someone i employed i would just decline to leave any reference.

The new employer told them the reason why the employment offer was withdrawn.
