"Heard yesterday that from October if you are sick in your hols then you are entitled to compensation from your employer. Im not sure of the comp but surely it can only be extra hols or extra pay ....... more than likely extra hols.. I think this is fooking madness... if you are sick on your day off isn't it just tough ? Why should your employer compensate you? Can the harseholes who just say it's great cos it goes there way not bother. Just those who can see the implications..... ta xx Well ?" Its very complicated and applies to employers who have a certain number of staff and its involved in what is an illness and what is a "sniffle" when you are on holiday.

"But then surely your employer wouldnt pay you, you would just get ssp, so it wouldnt be any real problem to them." Many employers make ssp up to full pay, so with them it would. This has been around, with many companies, for a long time. Only seen it used, when sickness has been for a longer period, that has over-ran the holiday period. For those that say people 'take the piss' enough with sick, I see very little of that. I see a lot more of people using holidays to cover sick, as they are in fear for their jobs.

"I do not agree to compensate in extra holidays. Those who already take the piss at being sick before and after weekends and during school holidays would no doubt try and get more holidays by claiming sick while on holiday. " Well if you are going to take away one entitlement then why not take them all ....I find the attitude that every employee is on the make very insulting to be honest....I personally work extremely hard and my holiday time is for just that...a holiday, not to be lying ill and unable to get the benefit from it and I have certainly never abused this system , I would think that what you talk about is more likely to happen in organisations that have no regard for their workers health or well being therefore they get no respect back in a sense.

""The European Court of Justice has expanded on its insistence that all workers throughout the EU have a right to reclaim holiday time affected by illness. The court ruling, made after an appeal by a Spanish trade union, is binding on all EU members, including Britain. The Luxembourg-based court insisted that employers should honour workers’ rights to both time off sick and paid holidays. “The purpose of entitlement to paid annual leave is to enable the worker to rest and enjoy a period of relaxation and leisure,” the court said. “The purpose of entitlement to sick leave is different, since it enables a worker to recover from an illness that has caused him to be unfit for work.” It would be “arbitrary and contrary to the purpose of entitlement to paid annual leave” to deny workers holiday time in exchange for time spent sick." Can see instances where an individual would have to call in sick whilst on holiday, if that sickness or illness was of a communicable nature and the employer had up to date policies on this.. if that was the case then yes their holiday entitlement probably would be kept.. not sure many would go sick for a short period whilst on holiday, as by and large most folk dont take the piss which phoning in sick for a bout of dickie tummy in a far away place would be tbh.. some may do so, thats the dynamics of some workplaces as with society at large.. would disagree that they may be 'harseholes' if that was their viewpoint.. any debate or discussion in any arena deserves the voices of all..

"An employee will be required to provide evidence of sickness whilst on holiday as calling in with a minor sniffle won't be accepted as a valid reason for being paid sick pay. Employers have to realise that the cost of running a business incorporates employee rights too and if a business cannot meet those costs then it doesn't deserve to be in business." Bloody hell! Unpaid overtime is a bug bear of mine as I work for Wishy Ltd first and foremost and forcing me to work unpaid hours earns money for the company and takes food out of my kid's mouths.

" Unlike HR people who never misrepresent workers rights or try to avoid the requirements of due process. Seriously, to both you and the OP I'd say why be so provocative? Those of us who care about workers rights do not have less rights or less morals than you. For every employee who 'takes the piss' there are more who are genuinely ill and end up being harassed by uncaring employers.

My own interpretation of this judgement is that if you're fit to travel on holiday you're not unfit for work, and I suspect that interpretation will come through in the English courts. That won's stop people posting the Daily Mail interpretation of the law of course...

Sorry Mike, but that's not your HR dept that's causing the issue. HR created your contract - your line manager is the one deviating from it, making you feel like you should work the extra hours and calling you at home (i'm assuming as HR would have no reason to) It's all too easy to blame HR for something without thinking about whose fault it really is.

The bad ones will try and bend every rules they can, and to squeeze as much out of the system as they can. "For the record, I DO care about workers rights. I've spent the last 2 months working a redundancy situation - many of whom were people I recruited myself. The whole team spent months and months making sure we were doing the best we could under the circumstances for the workforce. I had many a sleepless night in the last 2 weeks and also worked 12-14 hours a day whilst also travelling, to make sure each and every employee affected had a personal service from me where any query they had could be answered. Don't tar all single men with same brush? Don't tar all occupations with the same brush!" And dont tar all employees the same, now I know you'll come back with 'im not' but really, to be fair, you all are.....

" This wouldn't work, as the company would win-win. The pay-rise would be forfeited, and the redundancies would occur a short time later. We made this offer to our company, plus a small reduction in salary, on the proviso there would be no redundancies for 12 months. The company said they were prepared to accept our offer, without the proviso. You don't need to be Mystic Meg to see what would have happened.

"For every employee who 'takes the piss' there are more who are genuinely ill and end up being harassed by uncaring employers. I didn't say there weren't. Did I? I agree there are those that don't take the piss, but you can't deny there are those who DO and they don't need feeding any more opportunity. Please try not to put words into peoples mouths in future. Touchy aren't we?" Funny that eh! Why would I be touchy, having just worked over 100 hours in the last 2 weeks to be told I don't care about employees or even work a real job? Can't fathom it myself......
