That was proven years ago in a big tax case revolving around vat.

Basically they are cakes as when a cake goes stale they get hard Whereas a stake biscuit goes soft.

I would have to go for the custard cream, the bourbon pretends to be a chocolate biscuit but not sure if any real chocolate in it although certainly no real custard in the custard cream either.
