Hi everyone,

Is Swinging illegal?....The reason I ask...?

I have just been chatting with a friend of mine who used to be on this site and he's recently just been betrayed by a 'friend' on here.

He was a youth athletics coach and had a page on here with all his pics private but someone on his friends list took screenshots, the pics never had full pics, either private area or face pics but they were only available to friends, and the unknown person anonymously sent the pics to the work place of the person who was in charge of his running club.

The person in charge then started threatening him that he would out him to his gf if he didn't step down, he eventually told her and they split up and he lost his Mrs and his kid, he screen shot every message and went to the police and they said they could certainly speak to the person doing this but then he went to his athletic governing body and they said they would deal with the the person but it turned out that after a discipline committee meeting against him they club said he was to leave his role, now they are making false allegations against him and he's not having his PVG approved to join a new athletic club.

So my question is, is swinging illegal?

Are they allowed to do that and dismiss him? They made it out he was a risk to kids because he was on here!

Should he contact the police again and go through with pressing charges against the person but that would run the risk of it coming out in a court and then ending up in the papers etc... further embarrassment to his ex gf and family....

What would you do?

Swinging is not illegal (assuming consenting adults etc) - although dogging maybe is due to public indecency, but is rarely enforced it appears.

The predicament your friend got into is probably less likely to do with the law, but most companies and organisational guidelines have "bringing the organisational reputation into disrespute" as a gross misconduct offense and give them the legal ground to do so. It would depend on the specifics (what was shown to who, more so if it's working with kids, specifics of the contracts etc).

I'm not a legal expert, but held multiple HR meetings including on occasion using reputational damages as a gross misconduct offense (admitedly a bit more clean cut). Always worth seeking legal advice if he feels hard done by, but would imagine the law/organisational guidelines are not behind him on this one.

Does he know who actually sent them to the club? If so police are able to act upon this, it is classed as distribution of pornographic material without consent and the person who sent it can go to prison for it. Even if they only have suspicions of who it is the police can investigate it once it is actually sent as a crime has been committed.
