High profile case before the courts of a well known former GGA player who was labeled the 'biggest swimgerin town'. Paper are arguing it was somehow in the public interest to print details supplied by his ex partner.

Most disturbing aspect is it seems the paper told him they would not publish his details if he supplied a list of party attendees

- 'admitted telling the reporter he would supplying? the names of all who attended the parties if the newspapers agreed not to publish the article about him'.

This guy is claiming he lost his job as result of being outed. The defence is arguing he forfeited his right to privacy by attending the party. Going to be interesting

Everyone is entitled to a private life ,regardless of stature or employment.

I know there are those that are "outed and proud" but there is also a large proportion of this site want to remain deeply private about this part of their lives ,I have seen comments in the past that are condescending to the ones that remain secret. However when you put both groups in a large setting with mobile phones awash. It's certain that at some point someone will appear in a background image and be posted online forever

They printed photographs from the party, Given the abundance of smartphones, sexting, dick pics, personal selfies and people making their own videos. There's so many people at risk. If the person that initially shared the photos was breaking the law, then the Sunday World could not have ran the story like this. The newspaper has to operate within the law, claiming that they're just meeting a demand isn't really acceptable. Sure, sex sells, but at what price?

Same "newspaper" ran a story a good few years ago about an old neighbour of mine supposedly running a brothel from her home. There wasn't even a hint of truth in it. But just enough details about her that everyone in our estate knew who they were on about. All our doors were knocked on because she had the balls to take them to court. She won of course and got the tiny retraction paragraph compared to the 6 page spread they did.

Her real crime not keeping a clean house it offended her next door neighbour.

Whilst they praised Sickos like jimmy saville etc.

It's a tragic case but the likes of the sunday worst should be chasing worthy news stories like the "grace" foster family case or tax evasion by politicians. Oh wait that would take some real investigative journalism.

So this time next week a verdict should be reached.

Find myself in two minds about it. On one side he's a toe rag who I wouldn't mind seeing losing the case (and if he does the scumday world will have a field day in next weeks paper) but on the other side it raises issues for all swingers over our right to privacy at parties and socials. I know atm there is always a chance of someone taking pics on the sly but this could give the papers more of an incentive to try and infiltrate what should be our private world.

Time will tell

As far as i know theres no photos of the guy uploaded onto the internet so its not classed as revenge porn. Its not even classed as persistent harrassment because there wasnt any. From what i can gather in this case, the newspapers were contacted by his ex and photos were produced. They in turn printed the photos of him which is why hes suing them for breach of privacy and defamation.

Revenge porn isn't a specific offence in Ireland yet. You could still be charged with harassment for doing so. It due to be legislated for. From the Irish Times:

'The Law Reform Commission proposes the new and extended offences will carry, on summary conviction, the maximum penalties of a class A fine, currently a fine not exceeding €5,000, and/or up to 12 months’ imprisonment; and on conviction on indictment an unlimited fine and/or up to seven years’ imprisonment.'

Maybe now people might be a little more understanding when face pics aren't available on here. It's so dangerous for normal people who have pretty normal jobs and vanilla social lives. Even sending a face pic on fab is risky because you could easily be screen shotted. Fair play to those who have face pics on here but for me I think it's safer to exchange pics via different media.

In order to prove defamation, the claim has to proven false and repeated to a 3rd party. So he's saying that he's not actually a swinger, he was just there because his partner was. And by printing the photos and the headline 'biggest swinger in town' he's claiming that he was defamed and his privacy was invaded by printing the photos.

If you're a 'public figure' its harder to claim a right to privacy which is what the Sunday World will argue. You or me would have a stronger argument to claim invasion of privacy

I think the moral of the story is for now, either wear a balaclava if you're going to swinging parties or don't allow your photo to be taken.
