"So this time next week a verdict should be reached. Find myself in two minds about it. On one side he's a toe rag who I wouldn't mind seeing losing the case (and if he does the scumday world will have a field day in next weeks paper) but on the other side it raises issues for all swingers over our right to privacy at parties and socials. " As far as i know theres no photos of the guy uploaded onto the internet so its not classed as revenge porn. Its not even classed as persistent harrassment because there wasnt any. From what i can gather in this case, the newspapers were contacted by his ex and photos were produced. They in turn printed the photos of him which is why hes suing them for breach of privacy and defamation. | |||

" In order to prove defamation, the claim has to proven false and repeated to a 3rd party. So he's saying that he's not actually a swinger, he was just there because his partner was. And by printing the photos and the headline 'biggest swinger in town' he's claiming that he was defamed and his privacy was invaded by printing the photos. | |||

You or me would have a stronger argument to claim invasion of privacy I think the moral of the story is for now, either wear a balaclava if you're going to swinging parties or don't allow your photo to be taken. | |||
