Employee Advice!!

So i own and entertainment agency and pretty much everyone works for me on the weekends on various shows etc throughout the country

I have this one who has been with me since the start for the last year has cause nothing but problems! They have more bad reviews in then everyone else combined! The only one with refunds to give back

We are only how many weeks into this year and they are now on their 3rd bad review and 2nd refund! NOBODY else has anything in against them! They are showing up late and just been extremely unprofessional in everything

They started dating this waste of space the start of last year and pretty much since then all this has kicked in! Also they are the main earner for their family

I have been so lenient with everything as they been with so long and i know they need the work but its at a stage now where i dont trust them and if im honest i dont want them working for me!

I have given chance after chance, nothing is changing! I think i need to bite the bullet and just let them go but im not sure how! Ive never done it before!

Any advice!

Do you have a contract with them or do you just book them when you need them?

They are self employed but I get first choice on weekends! Like they have bookings in up until the end of August

All of the ones who work with me would pretty much leave me to fill their weekends up

They do have contracts on how the work etc should be done! They sign them at the start of the year and they broke pretty much everything on it so far already this year … in how many weeks

They obviously don't care that they are hurting your business. It's time to get rid and move on because it's sounds like you have given them enough chances already

You don't need someone like that out there representing you. You need to find out what your legal responsibility towards them is. If you're not sure you will need to take advise on employment law. This will happen when you are in business and is something all business owners need to be able to deal with. Good luck

The thread title and subsequent post sound conflicting to me. Title says employees, follow-up says they are self-employed?

If they're independent contractors surely you can just cut ties with them no?

Effectively they are self employed but I look after them well and they pretty much all consider me their boss in a way!

If they've been contracting with you for over a year then you may have obligations that you should look into.

In any case it's in your best interest to follow the correct protocol and formally inform your contractor that they are not meeting their contractual obligations.

That person is out here representing you and every refund/complaint is likely a client lost.

If they are self employed and you don’t have a contract of employment with them, you can cancel their remaining bookings.

If you have a contract of employment, you need to put things in writing to them and follow the appropriate steps based on the contract.

Yep but if that's the case there should be a huge difference here -

If you were employing them as PAYE earners I'd be advising to tread carefully and contact an outsourced HR company so the proper steps are taken and you don't find yourself a target or legal action and paying through the nose.

But in this case you say they are not honouring contracts and damaging your business in the process. That can't continue, I'd be saying thanks for everything but I'm needing to look elsewhere.

Thank you all so much!! I think that’s what I’m best to do

Just got the written complaint in from the agency I worked with and some of the stuff in it I’m like how can you think it’s ok (normally I take complaints with a grain of salt as people embellish a lot but when it’s a pattern of the same things)

I booked loads of acts over the years for clubs and pubs. If one act was repeatedly getting bad reviews, they weren't given any bookings and eventually left. As this person is self employed, you can use them as how you see fit. Build up a list of places that won't have them back to cover yourself. Otherwise it's you sho end up with the bad name.

It is a total minefield employment law and it is stacked totally in their favour. It will cost a few pound to get advice from a HR consultant but could end up saving you a small fortune down the road as it will cost them nothing to file loads of fabricated complaints with the WRC and trust me you don’t need that hassle and expense.

I actually have an agency who won’t allow them on any of their bookings and anyone who’s sketchy! Makes bookings a tad trickier

You certainly seem to be having a time of it with this person and as you have said there an independent contractor that has broken your contract rules quite often and it's only the start of March. You have 2 choices either you let things go on as they have been with them causing your company to get black marks from bookings which will lead to fewer bookings and loss of earnings or even your company going out of business or you put on your big boots and you sever ties with this person and try to salvage the wrong foings they have done and move forward and use this situation to make sure that your staff don't think your a walk over. Unfortunately the only way I see it is that person has to go apologies op if this isn't what you want to hear but you have to protect yourself and your employees as best you can

As a self employer contractor,there is very little you're responsible for. If you've giving verbal warnings and you haven't employed them for rolling contracts over years..if they aren't offering you a adequate service, you're within your rights to revoke contracts.
