Public pics??

I have the box ticked saying if someone has no public pics they cant contact me.

However of late I have noticed people getting thru this filter, the only thing I can think of is they have a profile pic even tho it is in their private gallery or totally private.

Is this why the messages are getting thru the filters, as I have not emailed the people before.
